Teda nem\u00e1 na Slovensku ani trval\u00fd pobyt, ani s\u00eddlo. Ob\u010dianstvo pritom samo osebe nie je rozhoduj\u00face, rozhoduje trval\u00fd pobyt, resp. v\u00a0pr\u00edpade pr\u00e1vnick\u00fdch os\u00f4b s\u00eddlo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Z\u00e1kladn\u00e9 pravidlo: cudzinec m\u00f4\u017ee na Slovensku k\u00fapi\u0165 nehnute\u013enos\u0165<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pod\u013ea <strong>\u00a7 19a Dev\u00edzov\u00e9ho z\u00e1kona<\/strong> plat\u00ed, \u017ee cudzozemec m\u00f4\u017ee nadobudn\u00fa\u0165 vlastn\u00edcke pr\u00e1vo k nehnute\u013enostiam v tuzemsku, <strong>okrem nehnute\u013enost\u00ed, ktor\u00fdch nadob\u00fadanie je obmedzen\u00e9 osobitn\u00fdmi predpismi<\/strong>. Medzi tieto osobitn\u00e9 predpisy patr\u00ed najm\u00e4 z\u00e1kon o ochrane po\u013enohospod\u00e1rskej p\u00f4dy, z\u00e1kon o lesoch a z\u00e1kon o nadob\u00fadan\u00ed vlastn\u00edctva po\u013enohospod\u00e1rskeho pozemku, ktor\u00fdm sa podrobnej\u0161ie venujeme ni\u017e\u0161ie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">V\u00fdnimka: po\u013enohospod\u00e1rska p\u00f4da a lesn\u00e9 pozemky<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Nadob\u00fadanie vlastn\u00edckeho pr\u00e1va k po\u013enohospod\u00e1rskym pozemkom upravuje osobitn\u00fd predpis \u2014 <strong>z\u00e1kon \u010d. <a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2014\/140\/20190211\" data-type=\"link\" data-id=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2014\/140\/20190211\">140\/2014 Z. z.<\/a> o nadob\u00fadan\u00ed vlastn\u00edctva po\u013enohospod\u00e1rskeho pozemku<\/strong> (\u010falej len \u201ez\u00e1kon o nadob\u00fadan\u00ed p\u00f4dy\u201c). S\u00fabe\u017ene treba ma\u0165 na pam\u00e4ti aj z\u00e1kon \u010d. 220\/2004 Z. z. o ochrane a vyu\u017e\u00edvan\u00ed po\u013enohospod\u00e1rskej p\u00f4dy a z\u00e1kon \u010d. 326\/2005 Z. z. o lesoch, ktor\u00e9 sa uplatnia pri lesn\u00fdch pozemkoch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1kon zakazuje nadobudn\u00fa\u0165 po\u013enohospod\u00e1rsky pozemok do vlastn\u00edctva \u0161t\u00e1tu, ob\u010dana \u0161t\u00e1tu, fyzickej osoby s pobytom alebo pr\u00e1vnickej osoby so s\u00eddlom v \u0161t\u00e1te, ktor\u00e9ho pr\u00e1vny poriadok neumo\u017e\u0148uje ob\u010danom Slovenskej republiky ani slovensk\u00fdm fyzick\u00fdm a pr\u00e1vnick\u00fdm osob\u00e1m nadob\u00fada\u0165 vlastn\u00edctvo k po\u013enohospod\u00e1rskemu pozemku (tzv. <strong>princ\u00edp reciprocity<\/strong>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>V\u00fdnimky zo z\u00e1kazu:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>nadobudnutie po\u013enohospod\u00e1rskeho pozemku <strong>deden\u00edm<\/strong> \u2014 plat\u00ed bez oh\u013eadu na \u0161t\u00e1tnu pr\u00edslu\u0161nos\u0165,<\/li>\n\n\n\n<li>nadob\u00fadanie ob\u010danmi a osobami so s\u00eddlom\/pobytom v <strong>\u010dlensk\u00fdch \u0161t\u00e1toch E\u00da, EHP a vo \u0160vaj\u010diarsku<\/strong>, ako aj v \u0161t\u00e1toch, pre ktor\u00e9 to vypl\u00fdva z medzin\u00e1rodnej zmluvy z\u00e1v\u00e4znej pre Slovensk\u00fa republiku.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Ktor\u00e9 pozemky obmedzenie v\u00f4bec nezah\u0155\u0148a<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1kon o nadob\u00fadan\u00ed p\u00f4dy sa napriek svojmu \u0161irok\u00e9mu n\u00e1zvu neuplatn\u00ed na v\u0161etky pozemky evidovan\u00e9 ako po\u013enohospod\u00e1rske. Z p\u00f4sobnosti z\u00e1kona s\u00fa vy\u0148at\u00e9:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>z\u00e1hrady<\/strong>,<\/li>\n\n\n\n<li>pozemky <strong>v zastavanom \u00fazem\u00ed obce<\/strong> (intravil\u00e1n),<\/li>\n\n\n\n<li>pozemky mimo zastavan\u00e9ho \u00fazemia obce ur\u010den\u00e9 pod\u013ea osobitn\u00fdch predpisov na <strong>in\u00e9 ne\u017e po\u013enohospod\u00e1rske vyu\u017eitie<\/strong>, s obmedzenou mo\u017enos\u0165ou po\u013enohospod\u00e1rskeho vyu\u017eitia, s v\u00fdmerou <strong>men\u0161ou ako 2 000 m\u00b2<\/strong>, pozemky <strong>pri\u013eahl\u00e9 k stavbe<\/strong>, s ktorou tvoria funk\u010dn\u00fd celok.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pr\u00edklad z praxe \u2014 z\u00e1hrada v intravil\u00e1ne<\/em><\/strong> Ob\u010dan Ir\u00e1nu kupuje spolu s rodinn\u00fdm domom v obci aj pri\u013eahl\u00fa z\u00e1hradu s v\u00fdmerou 900 m\u00b2, evidovan\u00fa v katastri ako orn\u00e1 p\u00f4da. Napriek druhu pozemku sa na\u0148 obmedzenia nevz\u0165ahuj\u00fa. Pozemok le\u017e\u00ed v zastavanom \u00fazem\u00ed obce a\u00a0je aj pozemkom tvoriacim funk\u010dn\u00fd celok s\u00a0pri\u013eahlou stavbou.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pr\u00edklady uplatnenia princ\u00edpu reciprocity<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ir\u00e1n<\/strong> &#8211; Ir\u00e1nske pr\u00e1vo (z\u00e1kon o nadob\u00fadan\u00ed nehnute\u013enost\u00ed cudzincami z r. 1928\/1949 a FIPPA z r. 2001) absol\u00fatne zakazuje cudzincovi nadobudn\u00fa\u0165 po\u013enohospod\u00e1rsku a priemyseln\u00fa p\u00f4du. Ide o plo\u0161n\u00fd z\u00e1kaz nez\u00e1visl\u00fd od reciprocity (na rozdiel od bytov\/domov, kde Ir\u00e1n reciprocitu sk\u00fama). Ke\u010f\u017ee ir\u00e1nsky pr\u00e1vny poriadok neumo\u017e\u0148uje slovensk\u00fdm ob\u010danom ani pr\u00e1vnick\u00fdm osob\u00e1m so s\u00eddlom na Slovensku nadob\u00fada\u0165 po\u013enohospod\u00e1rsku p\u00f4du v Ir\u00e1ne, \u00a7 7 ods. 1 z\u00e1kona \u010d. 140\/2014 Z. z. by sa uplatnil \u2013 ir\u00e1nski \u0161t\u00e1tni ob\u010dania, osoby s pobytom v Ir\u00e1ne a\u00a0pr\u00e1vnick\u00e9 osoby so s\u00eddlom v Ir\u00e1ne by nemohli nadobudn\u00fa\u0165 po\u013enohospod\u00e1rsky pozemok na Slovensku.<\/li>\n\n\n\n<li><strong>Spojen\u00e9 arabsk\u00e9 emir\u00e1ty <\/strong>&#8211; Vo v\u0161etk\u00fdch emir\u00e1toch (Dubaj, Abu Zab\u00ed, \u0160ard\u017ea a i.) je po\u013enohospod\u00e1rska p\u00f4da vyhraden\u00e1 len pre ob\u010danov SAE. Cudzinci m\u00f4\u017eu nadob\u00fada\u0165 nehnute\u013enosti len v tzv. freehold z\u00f3nach (byty, vily, komer\u010dn\u00e9 priestory). Po\u013enohospod\u00e1rska a priemyseln\u00e1 p\u00f4da je z tohto re\u017eimu vyl\u00fa\u010den\u00e1 pre kohoko\u013evek okrem \u0161t\u00e1tnych pr\u00edslu\u0161n\u00edkov SAE. Ke\u010f\u017ee pr\u00e1vny poriadok SAE neumo\u017e\u0148uje ani slovensk\u00fdm ob\u010danom a\u00a0pr\u00e1vnick\u00fdm osob\u00e1m so s\u00eddlom na Slovensku nadobudn\u00fa\u0165 u\u00a0nich po\u013enohospod\u00e1rsku p\u00f4du, \u00a7 7 z\u00e1kona by sa pravdepodobne uplatnil aj v\u00a0pr\u00edpade SAE.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Katastr\u00e1lne konanie: na \u010do si da\u0165 pozor pri cudzincoch<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aj ke\u010f cudzinec sp\u013a\u0148a v\u0161etky hmotnopr\u00e1vne podmienky na nadobudnutie nehnute\u013enosti, treba myslie\u0165 aj na form\u00e1lne n\u00e1le\u017eitosti n\u00e1vrhu na vklad vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00e1vrh na za\u010datie katastr\u00e1lneho konania mus\u00ed obsahova\u0165 identifika\u010dn\u00e9 \u00fadaje navrhovate\u013ea v rozsahu ur\u010denom Katastr\u00e1lnym z\u00e1konom. U fyzickej osoby ide \u0161tandardne o <strong>meno, priezvisko, rodn\u00e9 priezvisko, d\u00e1tum narodenia, rodn\u00e9 \u010d\u00edslo, miesto trval\u00e9ho pobytu<\/strong>, pr\u00edpadne adresu na doru\u010dovanie v tuzemsku, ak je odli\u0161n\u00e1 od trval\u00e9ho pobytu, a \u00fadaj o \u0161t\u00e1tnej pr\u00edslu\u0161nosti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cudzinci spravidla <strong>nemaj\u00fa pridelen\u00e9 slovensk\u00e9 rodn\u00e9 \u010d\u00edslo<\/strong> \u2014 namiesto neho sa uv\u00e1dza in\u00fd identifik\u00e1tor, v praxi napr\u00edklad <strong>\u010d\u00edslo cestovn\u00e9ho pasu alebo in\u00e9ho dokladu toto\u017enosti<\/strong>, \u010d\u00edslo soci\u00e1lneho poistenia alebo in\u00e9 osobn\u00e9 identifika\u010dn\u00e9 \u010d\u00edslo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ak m\u00e1 \u00fa\u010dastn\u00edk konania trval\u00fd pobyt alebo sa zdr\u017eiava v zahrani\u010d\u00ed, n\u00e1vrh mus\u00ed obsahova\u0165 aj <strong>adresu na doru\u010dovanie, ktor\u00e1 sa mus\u00ed nach\u00e1dza\u0165 na \u00fazem\u00ed Slovenskej republiky<\/strong>. V praxi sa na tento \u00fa\u010del \u010dasto vyu\u017e\u00edva adresa splnomocnen\u00e9ho advok\u00e1ta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pr\u00edklad z praxe \u2014 n\u00e1vrh na vklad pre kupuj\u00faceho z USA<\/em><\/strong> Ob\u010dan USA s trval\u00fdm pobytom mimo Slovenska kupuje byt v Bratislave. V n\u00e1vrhu na vklad namiesto rodn\u00e9ho \u010d\u00edsla uvedie \u010d\u00edslo svojho cestovn\u00e9ho pasu alebo social insurence number a ke\u010f\u017ee nem\u00e1 na Slovensku trval\u00fd pobyt, mus\u00ed uvies\u0165 aj adresu na doru\u010dovanie v&nbsp;tuzemsku, napr. adresu advok\u00e1tskej kancel\u00e1rie, ktor\u00e1 ho v konan\u00ed zastupuje.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Zhrnutie<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cudzinec m\u00f4\u017ee na Slovensku <strong>bez obmedzen\u00ed<\/strong> nadobudn\u00fa\u0165 byt, rodinn\u00fd dom alebo in\u00fd pozemok mimo osobitn\u00e9ho re\u017eimu \u2014 nepotrebuje trval\u00fd ani prechodn\u00fd pobyt.<\/li>\n\n\n\n<li>Obmedzenie sa t\u00fdka najm\u00e4 <strong>po\u013enohospod\u00e1rskej p\u00f4dy a lesn\u00fdch pozemkov<\/strong>.<\/li>\n\n\n\n<li>V\u00fdnimku z obmedzenia maj\u00fa <strong>ob\u010dania a spolo\u010dnosti z E\u00da, EHP a \u0160vaj\u010diarska<\/strong>, ako aj nadobudnutie pozemkov <strong>deden\u00edm<\/strong>.<\/li>\n\n\n\n<li>Pri katastr\u00e1lnom konan\u00ed treba myslie\u0165 na <strong>n\u00e1hradn\u00fd identifik\u00e1tor<\/strong> namiesto rodn\u00e9ho \u010d\u00edsla a na <strong>adresu na doru\u010dovanie na Slovensku<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pl\u00e1nujete k\u00fapu nehnute\u013enosti na Slovensku a nie ste si ist\u00ed, \u010di sa vo Va\u0161om pr\u00edpade uplatn\u00ed niektor\u00e1 z uveden\u00fdch v\u00fdnimiek, alebo potrebujete pripravi\u0165 kompletn\u00fa zmluvn\u00fa dokument\u00e1ciu a podanie na?<strong> <a href=\"https:\/\/www.lidaybasaryova.sk\/en\/kontakt\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/kontakt\/\">Contact us.<\/a>, pos\u00fadime V\u00e1\u0161 konkr\u00e9tny pr\u00edpad a prevedieme V\u00e1s cel\u00fdm procesom.<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Cudzinec m\u00f4\u017ee na Slovensku vo v\u00e4\u010d\u0161ine pr\u00edpadov bez obmedzen\u00ed k\u00fapi\u0165 byt, dom \u010di pozemok.
