Vypo\u017ei\u010diavate\u013e je opr\u00e1vnen\u00fd vec u\u017e\u00edva\u0165 bezodplatne, teda bez poskytovania ur\u010ditej protihodnoty po\u017ei\u010diavate\u013eovi. Bezodplatnos\u0165 v\u0161ak nevylu\u010duje, aby vypo\u017ei\u010diavate\u013e uhr\u00e1dzal <strong>n\u00e1klady spojen\u00e9 s&nbsp;u\u017e\u00edvan\u00edm veci<\/strong>, pr\u00edpadne aj <strong>n\u00e1hradu za opotrebenie<\/strong> alebo zni\u017eovanie hodnoty veci.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;z\u00e1ujme pr\u00e1vnej istoty odpor\u00fa\u010dame v&nbsp;zmluve v\u00fdslovne upravi\u0165 vymedzenie n\u00e1kladov spojen\u00fdch s&nbsp;u\u017e\u00edvan\u00edm bytu (napr. elektrina, plyn, likvid\u00e1cia odpadov, vodn\u00e9 a&nbsp;sto\u010dn\u00e9, k\u00farenie a&nbsp;ohrev vody, k\u00e1blov\u00e1 telev\u00edzia, internet a&nbsp;pod.), sp\u00f4sob ur\u010denia ich v\u00fd\u0161ky, sp\u00f4sob a&nbsp;lehoty \u00fahrady, vy\u00fa\u010dtovanie preplatkov a nedoplatkov a&nbsp;pod.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Napriek bezodplatnosti nie je medzi po\u017ei\u010diavate\u013eom a&nbsp;vypo\u017ei\u010diavate\u013eom vyl\u00fa\u010den\u00e1 ani dohoda na \u00fahrade n\u00e1hrady za opotrebenie veci po\u010das jej u\u017e\u00edvania vypo\u017ei\u010diavate\u013eom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Z&nbsp;rozhodovacej praxe s\u00fadov:<\/strong> Krajsk\u00fd s\u00fad v \u010cesk\u00fdch Bud\u011bjoviciach, sp. zn. 22 Co 577\/2003, v&nbsp;rozsudku nesk\u00f4r potvrdenom Najvy\u0161\u0161\u00edm s\u00fadom \u010cR, sp. zn. 28 Cdo 2369\/2003 uv\u00e1dza: \u201e\u2026i kdy\u017e smlouva o v\u00fdp\u016fj\u010dce je bezplatn\u00e1, nen\u00ed vylou\u010dena dohoda o ur\u010dit\u00e9 n\u00e1hrad\u011b za opot\u0159eben\u00ed p\u016fj\u010den\u00e9 v\u011bci, jak tomu bylo v dan\u00e9m p\u0159\u00edpad\u011b.\u201c<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;pr\u00edpade dojednania n\u00e1hrady za opotrebenie je v\u0161ak potrebn\u00e9 d\u00f4sledne nastavi\u0165 v\u00fd\u0161ku n\u00e1hrady tak, aby u\u017e de facto ne\u0161lo o&nbsp;\u00fahradu za u\u017e\u00edvanie. N\u00e1hrada by v&nbsp;praxi mohla zahr\u0148ova\u0165 napr. n\u00e1klady na profesion\u00e1lne upratanie bytu, jeho vyma\u013eovanie a&nbsp;pod. po ukon\u010den\u00ed v\u00fdpo\u017ei\u010dky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;zmluve o&nbsp;v\u00fdpo\u017ei\u010dke odpor\u00fa\u010dame dohodn\u00fa\u0165 aj uhr\u00e1dzanie be\u017en\u00fdch opr\u00e1v a&nbsp;\u00fadr\u017eby do ur\u010ditej sumy vypo\u017ei\u010diavate\u013eom.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Doba v\u00fdpo\u017ei\u010dky<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ke\u010f\u017ee jedn\u00fdm zo z\u00e1kladn\u00fdch z\u00e1konn\u00fdch znakov v\u00fdpo\u017ei\u010dky je do\u010dasnos\u0165, odpor\u00fa\u010dame do zmluvy presn\u00e9 \u010dasov\u00e9 vymedzenie trvania v\u00fdpo\u017ei\u010dky. V zmluve ale m\u00f4\u017ee by\u0165 zakotven\u00fd aj mechanizmus automatick\u00e9ho predl\u017eovania v\u00fdpo\u017ei\u010dky po splnen\u00ed dohodnut\u00fdch podmienok.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Takisto je d\u00f4le\u017eit\u00e9 myslie\u0165 aj na \u00fapravu mo\u017enost\u00ed ukon\u010denia zmluvy o&nbsp;v\u00fdpo\u017ei\u010dke. Je mo\u017en\u00e9 zakotvenie d\u00f4vodov na odst\u00fapenie od zmluvy, ktor\u00e9 by nastalo doru\u010den\u00edm odst\u00fapenia druhej zmluvnej strane aj dojednanie v\u00fdpovede bez uvedenia d\u00f4vodu s&nbsp;uplynut\u00edm dohodnutej v\u00fdpovednej doby.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Z rozhodovacej praxe s\u00fadov:<\/strong> Pod\u013ea rozsudku Najvy\u0161\u0161ieho s\u00fadu \u010cR, sp. zn. 22 Cdo 421\/2001: \u201e&#8230; nebyla-li ur\u010dena ani doba ani \u00fa\u010del u\u017e\u00edv\u00e1n\u00ed, nevznik\u00e1 skute\u010dn\u00e1 smlouva, n\u00fdbr\u017e nez\u00e1vazn\u00e1 v\u00fdprosa (prekarium) a p\u016fj\u010ditel m\u016f\u017ee \u017e\u00e1dati za vr\u00e1cen\u00ed v\u011bci p\u016fj\u010den\u00e9, kdy je mu libo.\u201c<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Povinnosti vypo\u017ei\u010diavate\u013ea<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Je potrebn\u00e9 zd\u00f4razni\u0165, \u017ee aj po\u010das trvania v\u00fdpo\u017ei\u010dky je vlastn\u00edkom bytu po\u017ei\u010diavate\u013e, ako vlastn\u00edk aj za svoj majetok zodpoved\u00e1, preto v&nbsp;zmluve o&nbsp;v\u00fdpo\u017ei\u010dke odpor\u00fa\u010dame vymedzi\u0165 aj povinnosti a&nbsp;obmedzenia pre vypo\u017ei\u010diavate\u013ea, tak aby bol po\u017ei\u010diavate\u013e a&nbsp;jeho majetok pr\u00e1vne chr\u00e1nen\u00fd.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pod\u013ea konkr\u00e9tnych okolnost\u00ed odpor\u00fa\u010dame zv\u00e1\u017ei\u0165 napr. tieto dojednania:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>presn\u00e9 \u0161pecifikovanie \u00fa\u010delu v\u00fdpo\u017ei\u010dky,<\/li>\n\n\n\n<li>prehl\u00e1senie vypo\u017ei\u010diavate\u013ea o&nbsp;obozn\u00e1men\u00ed sa s&nbsp;technick\u00fdm stavom vypo\u017ei\u010diavanej veci,<\/li>\n\n\n\n<li>povinnos\u0165 vypo\u017ei\u010diavate\u013ea dodr\u017eiava\u0165 domov\u00fd poriadok, pravidl\u00e1 ochrany pred po\u017eiarmi a&nbsp;pod.,<\/li>\n\n\n\n<li>z\u00e1kaz stavebn\u00fdch \u00faprav v&nbsp;byte bez predch\u00e1dzaj\u00faceho p\u00edsomn\u00e9ho s\u00fahlasu vypo\u017ei\u010diavate\u013ea,<\/li>\n\n\n\n<li>z\u00e1kaz prenechania bytu alebo umo\u017enenia u\u017e\u00edvania tret\u00edm osob\u00e1m,<\/li>\n\n\n\n<li>dojednania v&nbsp;s\u00favislosti so zodpovednos\u0165ou za \u0161kody sp\u00f4soben\u00e9 vypo\u017ei\u010diavate\u013eom alebo osobami, ktor\u00e9 pust\u00ed do bytu,<\/li>\n\n\n\n<li>pr\u00e1vo po\u017ei\u010diavate\u013ea uskuto\u010d\u0148ova\u0165 kontroly bytu,<\/li>\n\n\n\n<li>povinnos\u0165 vypo\u017ei\u010diavate\u013ea udr\u017eiava\u0165 poriadok a&nbsp;\u010distotu, zabezpe\u010dova\u0165 be\u017en\u00e9 opravy a&nbsp;\u00fadr\u017ebu,<\/li>\n\n\n\n<li>z\u00e1kaz faj\u010denia,<\/li>\n\n\n\n<li>z\u00e1kaz chovu dom\u00e1cich zvierat bez s\u00fahlasu po\u017ei\u010diavate\u013ea,<\/li>\n\n\n\n<li>poistenie vec\u00ed vypo\u017ei\u010diavate\u013ea vnesen\u00fdch do vypo\u017ei\u010dan\u00e9ho bytu na vlastn\u00e9 n\u00e1klady vypo\u017ei\u010diavate\u013ea, poistenie zodpovednosti vypo\u017ei\u010diavate\u013ea za \u0161kodu,<\/li>\n\n\n\n<li>povinnos\u0165 vr\u00e1ti\u0165 byt v p\u00f4vodnom stave (upratan\u00fd, vyma\u013eovan\u00fd a&nbsp;pod.),<\/li>\n\n\n\n<li>sp\u00edsanie preberacieho a&nbsp;odovzd\u00e1vacieho protokolu pri za\u010dat\u00ed a&nbsp;skon\u010den\u00ed v\u00fdpo\u017ei\u010dky so \u0161pecifik\u00e1ciou vec\u00ed nach\u00e1dzaj\u00facich sa v&nbsp;byte a&nbsp;stavom mera\u010dov,<\/li>\n\n\n\n<li>dojednanie, \u010di sa zmluva vz\u0165ahuje iba na konkr\u00e9tneho vypo\u017ei\u010diavate\u013ea \/ po\u017ei\u010diavate\u013ea alebo aj na pr\u00edpadn\u00fdch pr\u00e1vnych n\u00e1stupcov,<\/li>\n\n\n\n<li>in\u00e9 pod\u013ea konkr\u00e9tnych okolnost\u00ed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Okrem toho sa po\u017ei\u010diavate\u013e a&nbsp;vypo\u017ei\u010diavate\u013e m\u00f4\u017eu v&nbsp;zmluve o&nbsp;v\u00fdpo\u017ei\u010dke dohodn\u00fa\u0165 aj na&nbsp;<strong>zabezpe\u010den\u00ed z\u00e1v\u00e4zku<\/strong> napr. vo forme zmluvnej pokuty, \u00farokov z&nbsp;ome\u0161kania, zlo\u017een\u00edm depozitu a&nbsp;pod.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Zmluva o v\u00fdpo\u017ei\u010dke bytu je praktick\u00fdm n\u00e1strojom, ako pr\u00e1vne upravi\u0165 bezplatn\u00e9 b\u00fdvanie. Spr\u00e1vne nastaven\u00e9 podmienky chr\u00e1nia vlastn\u00edka aj u\u017e\u00edvate\u013ea nehnute\u013enosti.
