pri poskytovan\u00ed t\u00fdchto inform\u00e1ci\u00ed je predseda alebo spr\u00e1vca povinn\u00fd zabezpe\u010di\u0165 ochranu osobn\u00fdch \u00fadajov pod\u013ea osobitn\u00e9ho predpisu.\u201c<\/p>\n\n\n\n<p>Pod\u013ea \u00a7 11 ods. 6 z\u00e1kona o&nbsp;vlastn\u00edctve bytov a&nbsp;nebytov\u00fdch priestorov: \u201eVlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome m\u00e1 pr\u00e1vo nahliada\u0165 do dokladov t\u00fdkaj\u00facich sa spr\u00e1vy domu alebo \u010derpania fondu prev\u00e1dzky, \u00fadr\u017eby a opr\u00e1v a robi\u0165 si z nich v\u00fdpisy, odpisy a k\u00f3pie.\u201c<\/p>\n\n\n\n<p>Pokia\u013e v\u00e1m spr\u00e1vca nebol ochotn\u00fd dokumenty spr\u00edstupni\u0165 napr. na z\u00e1klade neform\u00e1lnej \u017eiadosti, odpor\u00fa\u010dame mu zasla\u0165 ofici\u00e1lnu p\u00edsomn\u00fa \u017eiados\u0165 o&nbsp;spr\u00edstupnenie dokumentov. Ak dokumenty nebud\u00fa spr\u00edstupnen\u00e9 ani na z\u00e1klade ofici\u00e1lnej \u017eiadosti, tak m\u00e1te mo\u017enos\u0165 dom\u00e1ha\u0165 sa spr\u00edstupnenia s\u00fadnou cestou.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zvolanie-schodze-vlastnikmi\"><strong>Zvolanie sch\u00f4dze vlastn\u00edkmi a\u00a0prijatie uznesenia<\/strong><\/h2>\n\n\n\n<p>Pri spr\u00e1ve domu je spr\u00e1vca povinn\u00fd zvola\u0165 sch\u00f4dzu vlastn\u00edkov pod\u013ea potreby, najmenej raz za rok, <strong>alebo ke\u010f o to po\u017eiadaj\u00fa vlastn\u00edci bytov a nebytov\u00fdch priestorov v dome, ktor\u00ed maj\u00fa aspo\u0148 \u0161tvrtinu hlasov<\/strong>. Sch\u00f4dza vlastn\u00edkov alebo za\u010datie p\u00edsomn\u00e9ho hlasovania sa mus\u00ed uskuto\u010dni\u0165 do 15 dn\u00ed od doru\u010denia \u017eiadosti predsedu alebo aspo\u0148 \u0161tvrtiny vlastn\u00edkov bytov a nebytov\u00fdch priestorov v dome.<\/p>\n\n\n\n<p>Ak spr\u00e1vca (alebo v&nbsp;pr\u00edpade spolo\u010denstva vlastn\u00edkov rada) v tomto term\u00edne nekon\u00e1, pr\u00e1vo zvola\u0165 sch\u00f4dzu vlastn\u00edkov alebo vyhl\u00e1si\u0165 p\u00edsomn\u00e9 hlasovanie m\u00e1 aspo\u0148 \u0161tvrtina vlastn\u00edkov bytov a nebytov\u00fdch priestorov v dome alebo predseda.<\/p>\n\n\n\n<p>Ak m\u00e1te v\u00fdhrady k&nbsp;\u010dinnosti spr\u00e1vcu, m\u00f4\u017eete teda navrhn\u00fa\u0165 uskuto\u010dnenie sch\u00f4dze vlastn\u00edkov alebo ak s\u00fa splnen\u00e9 z\u00e1konn\u00e9 podmienky, aj sch\u00f4dzu zvola\u0165. Pod\u013ea \u00a7 14b ods. 1, p\u00edsm. e) z\u00e1kona o&nbsp;vlastn\u00edctve bytov a&nbsp;nebytov\u00fdch priestorov: \u201eVlastn\u00edci bytov a nebytov\u00fdch priestorov v dome prij\u00edmaj\u00fa rozhodnutia nadpolovi\u010dnou v\u00e4\u010d\u0161inou hlasov v\u0161etk\u00fdch vlastn\u00edkov bytov a nebytov\u00fdch priestorov v dome, ak hlasuj\u00fa o zmluve o v\u00fdkone spr\u00e1vy, jej zmene, <strong>z\u00e1niku alebo v\u00fdpovedi<\/strong> a o poveren\u00ed osoby opr\u00e1vnenej podp\u00edsa\u0165 tieto pr\u00e1vne \u00fakony po schv\u00e1len\u00ed vlastn\u00edkmi bytov a nebytov\u00fdch priestorov v&nbsp;dome.<\/p>\n\n\n\n<p>Ako vypl\u00fdva z&nbsp;vy\u0161\u0161ie uveden\u00e9ho, aby sa v\u00e1m podarilo dosiahnu\u0165 zmenu spr\u00e1vcu, je potrebn\u00e9 presved\u010di\u0165 nadpolovi\u010dn\u00fa v\u00e4\u010d\u0161inu v\u0161etk\u00fdch vlastn\u00edkov bytov.<\/p>\n\n\n\n<p>Ak by ste sa chceli pusti\u0165 touto cestou, odpor\u00fa\u010dame, aby ste si vyhliadli nov\u00e9ho spr\u00e1vcu (alebo sa so susedmi dohodli na zalo\u017een\u00ed spolo\u010denstva vlastn\u00edkov) e\u0161te predt\u00fdm, ako vypoviete zmluvu o&nbsp;v\u00fdkone spr\u00e1vy s\u00fa\u010dasn\u00e9mu spr\u00e1vcovi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ako-podat-podnet-na-SOI\"><strong>Ako poda\u0165 podnet na Slovensk\u00fa obchodn\u00fa in\u0161pekciu (SOI)<\/strong><\/h2>\n\n\n\n<p>Vo\u010di postupu spr\u00e1vcu bytov\u00e9ho domu sa m\u00f4\u017eete br\u00e1ni\u0165 aj podan\u00edm podnetu na <a href=\"https:\/\/www.soi.sk\/\" data-type=\"link\" data-id=\"https:\/\/www.soi.sk\/\">Slovensk\u00fa obchodn\u00fa in\u0161pekciu (SOI)<\/a>. SOI nie je opr\u00e1vnen\u00e1 rie\u0161i\u0165 v\u0161etky druhy probl\u00e9mov, ktor\u00e9 m\u00f4\u017eu vznikn\u00fa\u0165 v\u00a0s\u00favislosti s\u00a0spr\u00e1vou bytov\u00e9ho domu.<\/p>\n\n\n\n<p>Na SOI sa m\u00f4\u017eete obr\u00e1ti\u0165 v&nbsp;pr\u00edpade, ak m\u00e1te podozrenie, \u017ee sa&nbsp; spr\u00e1vca dopustil poru\u0161enia pr\u00e1vnych predpisov na ochranu spotrebite\u013ea, nekal\u00fdch obchodn\u00fdch prakt\u00edk alebo nesplnenia zmluvn\u00fdch povinnost\u00ed spr\u00e1vcu.<\/p>\n\n\n\n<p>Podnet na SOI m\u00f4\u017eete poda\u0165:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>elektronicky prostredn\u00edctvom <a href=\"https:\/\/www.slovensko.sk\/sk\/titulna-stranka\" data-type=\"link\" data-id=\"https:\/\/www.slovensko.sk\/sk\/titulna-stranka\">\u00fastredn\u00e9ho port\u00e1lu verejnej spr\u00e1vy<\/a>, pri\u010dom je v\u0161ak potrebn\u00e9 vedie\u0165 pou\u017e\u00edva\u0165 kvalifikovan\u00fd elektronick\u00fd podpis,<\/li>\n\n\n\n<li>v\u00a0listinnej forme zaslan\u00edm po\u0161tou na adresu: \u00dastredn\u00fd in\u0161pektor\u00e1t SOI, Bajkalsk\u00e1 21\/A, P.O. BOX 29, 820 07 Bratislava 27 alebo aj<\/li>\n<\/ul>\n\n\n\n<p>osobne na region\u00e1lnom in\u0161pektor\u00e1te SOI.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ako-postupovat-ak-vam-spravca-sposobil-skodu\"><strong>Ako postupova\u0165 ak v\u00e1m spr\u00e1vca sp\u00f4sobil \u0161kodu?<\/strong><\/h2>\n\n\n\n<p>Spr\u00e1vca bytov\u00e9ho domu zodpoved\u00e1 vlastn\u00edkom bytov za v\u0161etky \u0161kody vzniknut\u00e9 v d\u00f4sledku neplnenia alebo nedostato\u010dn\u00e9ho plnenia svojich povinnost\u00ed vypl\u00fdvaj\u00facich zo z\u00e1kona alebo zo zmluvy o v\u00fdkone spr\u00e1vy. Spr\u00e1vca zodpoved\u00e1 za \u0161kodu, ktor\u00fa sp\u00f4sob\u00ed v s\u00favislosti s v\u00fdkonom spr\u00e1vcovskej \u010dinnosti.<\/p>\n\n\n\n<p>Spr\u00e1vca zodpoved\u00e1 aj za \u0161kodu, ktor\u00fa v s\u00favislosti s v\u00fdkonom spr\u00e1vcovskej \u010dinnosti sp\u00f4sob\u00ed jeho zamestnanec alebo osoba, ktor\u00fa poveril vykonan\u00edm jednotliv\u00fdch \u00fakonov spr\u00e1vcovskej \u010dinnosti.<\/p>\n\n\n\n<p>Spr\u00e1vca sa m\u00f4\u017ee zodpovednosti za \u0161kodu zbavi\u0165, a&nbsp;to v pr\u00edpadoch, ak preuk\u00e1\u017ee, \u017ee \u0161kode nemohol zabr\u00e1ni\u0165 ani pri vynalo\u017een\u00ed v\u0161etk\u00e9ho \u00fasilia, ktor\u00e9 bolo mo\u017en\u00e9 od neho po\u017eadova\u0165.<\/p>\n\n\n\n<p>Spr\u00e1vca je v&nbsp;zmysle z\u00e1kona povinn\u00fd ma\u0165 uzatvoren\u00fa poistn\u00fa zmluvu o poisten\u00ed zodpovednosti za \u0161kodu.<\/p>\n\n\n\n<p>Ak spr\u00e1vca sp\u00f4sobil \u0161kodu, odpor\u00fa\u010dame, aby ste ho najprv vyzvali, aby \u0161kodu nahradil dobrovo\u013ene. Ak k&nbsp;dobrovo\u013en\u00e9mu plneniu ned\u00f4jde, bude potrebn\u00e9 obr\u00e1ti\u0165 sa na s\u00fad. Pre priznanie n\u00e1roku na n\u00e1hradu \u0161kody v\u0161ak mus\u00ed ma\u0165 s\u00fad za preuk\u00e1zan\u00e9, \u017ee \u0161koda naozaj vznikla, ak\u00e9 je vy\u010d\u00edslenie \u0161kody, \u017ee do\u0161lo k&nbsp;poru\u0161eniu z\u00e1kona a \/ alebo zmluvy zo strany spr\u00e1vcu a&nbsp;\u017ee medzi poru\u0161en\u00edm a&nbsp;vzniku \u0161kody je pr\u00ed\u010dinn\u00e1 s\u00favislos\u0165.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"trestny-cin-pri-sprave-bytoveho-domu\"><strong>Trestn\u00fd \u010din pri spr\u00e1ve bytov\u00e9ho domu<\/strong><\/h2>\n\n\n\n<p>V&nbsp;niektor\u00fdch pr\u00edpadoch poru\u0161enia povinnost\u00ed zo strany spr\u00e1vcu dokonca m\u00f4\u017ee \u00eds\u0165 aj o&nbsp;trestn\u00fd \u010din. V&nbsp;praxi m\u00f4\u017ee naj\u010dastej\u0161ie \u00eds\u0165 o&nbsp;trestn\u00e9 \u010diny:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sprenevera,<\/li>\n\n\n\n<li>poru\u0161ovanie povinnosti pri spr\u00e1ve cudzieho majetku,<\/li>\n\n\n\n<li>po\u0161kodzovanie cudz\u00edch pr\u00e1v<\/li>\n<\/ul>\n\n\n\n<p>Ak m\u00e1te podozrenie, \u017ee sa spr\u00e1vca dopustil trestn\u00e9ho \u010dinu, m\u00f4\u017eete poda\u0165 trestn\u00e9 ozn\u00e1menie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"trestne-oznamenie-na-spravcu-bytoveho-domu\"><strong>Trestn\u00e9 ozn\u00e1menie na spr\u00e1vcu bytov\u00e9ho domu \u2013 kedy a\u00a0ako<\/strong><\/h2>\n\n\n\n<p>Pokia\u013e ste sa dozvedeli o\u00a0skuto\u010dnostiach, ktor\u00e9 nasved\u010duj\u00fa sp\u00e1chanie trestn\u00e9ho \u010dinu, m\u00f4\u017eete poda\u0165 trestn\u00e9 ozn\u00e1menie. Trestn\u00e9 ozn\u00e1menie odpor\u00fa\u010dame poda\u0165 na prokurat\u00fare alebo okresnom riadite\u013estve policajn\u00e9ho zboru.
