{"id":4172,"date":"2025-03-15T20:39:45","date_gmt":"2025-03-15T19:39:45","guid":{"rendered":"https:\/\/www.lidaybasaryova.sk\/?p=4172"},"modified":"2025-03-15T20:39:49","modified_gmt":"2025-03-15T19:39:49","slug":"elektronicke-hlasovanie-vlastnikov-bytov","status":"publish","type":"post","link":"https:\/\/www.lidaybasaryova.sk\/en\/elektronicke-hlasovanie-vlastnikov-bytov\/","title":{"rendered":"Electronic voting of apartment owners"},"content":{"rendered":"<p>01.01.2025 nadobudla \u00fa\u010dinnos\u0165 novela z\u00e1kona o\u00a0vlastn\u00edctve bytov a\u00a0nebytov\u00fdch priestorov, pod\u013ea ktorej m\u00f4\u017eu vlastn\u00edci bytov a\u00a0nebytov\u00fdch priestorov pri v\u00fdkone svojich pr\u00e1v hlasova\u0165 aj elektronick\u00fdmi prostriedkami. \u00da\u010dinnos\u0165 novely bola nastaven\u00e1 tak, aby naviazala na pandemick\u00e9 predpisy, ktor\u00e9 upravovali elektronick\u00e9 hlasovanie vlastn\u00edkov bytov a nebytov\u00fdch priestorov a definit\u00edvne stratili \u00fa\u010dinnos\u0165 31. decembra 2024.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Hlasovanie elektronick\u00fdmi prostriedkami<\/strong><\/h2>\n\n\n\n<p>Hlasovanie elektronick\u00fdmi prostriedkami je mo\u017en\u00e9 vyu\u017ei\u0165 len pri p\u00edsomnom hlasovan\u00ed.<\/p>\n\n\n\n<p>Pod\u013ea \u00a7 14a ods. 2 <a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/1993\/182\/20250101\" data-type=\"link\" data-id=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/1993\/182\/20250101\">z\u00e1kona o\u00a0vlastn\u00edctve bytov a\u00a0nebytov\u00fdch priestorov<\/a>: \u201eRozhodnutia vlastn\u00edkov bytov a nebytov\u00fdch priestorov v dome sa prij\u00edmaj\u00fa na sch\u00f4dzi vlastn\u00edkov alebo p\u00edsomn\u00fdm hlasovan\u00edm; na \u00fa\u010dely rozhodovania vlastn\u00edkov sa za sch\u00f4dzu vlastn\u00edkov pova\u017euje aj zhroma\u017edenie. Vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome m\u00f4\u017ee uplatni\u0165 svoje hlasovacie pr\u00e1vo pri p\u00edsomnom hlasovan\u00ed na hlasovacej listine alebo prostredn\u00edctvom prostriedkov informa\u010dnej a komunika\u010dnej technol\u00f3gie (\u010falej len \u201eelektronick\u00e9 hlasovanie\u201c); elektronick\u00e9 hlasovanie nemo\u017eno uplatni\u0165, ak p\u00edsomn\u00e9 hlasovanie vyhlasuje \u0161tvrtina vlastn\u00edkov bytov a nebytov\u00fdch priestorov v dome.<\/p>\n\n\n\n<p>Povinnos\u0165 zabezpe\u010di\u0165 elektronick\u00e9 hlasovanie sa teda vz\u0165ahuje iba na spolo\u010denstvo vlastn\u00edkov bytov alebo spr\u00e1vcu, preto\u017ee z\u00e1kon uklad\u00e1 t\u00fato povinnos\u0165 len t\u00fdmto subjektom. Vlastn\u00edci (ak zvolaj\u00fa sch\u00f4dzu) nie s\u00fa povinn\u00ed zabezpe\u010di\u0165 elektronick\u00e9 hlasovanie.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/zaloba-prehlasovaneho-vlastnika-bytu\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/zaloba-prehlasovaneho-vlastnika-bytu\/\">A lawsuit by an overruled apartment owner<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Povinnosti spr\u00e1vcu alebo spolo\u010denstva pri elektronickom hlasovan\u00ed<\/strong><\/h2>\n\n\n\n<p>Pod\u013ea \u00a7 14a ods. 5 z\u00e1kona o vlastn\u00edctve bytov a&nbsp;nebytov\u00fdch priestorov: \u201eAk pri p\u00edsomnom hlasovan\u00ed vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome prejav\u00ed z\u00e1ujem hlasova\u0165 elektronicky, vykonanie elektronick\u00e9ho hlasovania zabezpe\u010d\u00ed spolo\u010denstvo alebo spr\u00e1vca.<\/p>\n\n\n\n<p>Pri elektronickom hlasovan\u00ed spolo\u010denstvo alebo spr\u00e1vca mus\u00ed:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>vykona\u0165 v\u0161etky opatrenia potrebn\u00e9 na zabezpe\u010denie riadneho a neru\u0161en\u00e9ho priebehu elektronick\u00e9ho hlasovania,<\/li>\n\n\n\n<li>prij\u00edma\u0165 hlasy uplatnen\u00e9 elektronick\u00fdm hlasovan\u00edm odo d\u0148a uverejnenia ozn\u00e1menia o konan\u00ed p\u00edsomn\u00e9ho hlasovania najnesk\u00f4r do konca term\u00ednu ur\u010den\u00e9ho na p\u00edsomn\u00e9 hlasovanie,<\/li>\n\n\n\n<li>potvrdi\u0165 bez zbyto\u010dn\u00e9ho odkladu prijatie hlasu tomu, kto uplatnil svoje hlasovacie pr\u00e1vo elektronick\u00fdm hlasovan\u00edm; potvrdenie o prijat\u00ed hlasu sa vykon\u00e1 rovnak\u00fdm sp\u00f4sobom ako elektronick\u00e9 hlasovanie.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Vykonanie elektronick\u00e9ho hlasovania<\/strong><\/h2>\n\n\n\n<p>Pod\u013ea \u00a7 14a ods. 6 z\u00e1kona o vlastn\u00edctve bytov a&nbsp;nebytov\u00fdch priestorov: Na \u00fa\u010dely elektronick\u00e9ho hlasovania vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome ozn\u00e1mi spolo\u010denstvu alebo spr\u00e1vcovi svoju elektronick\u00fa adresu. Elektronick\u00e9 hlasovanie mus\u00ed by\u0165 vykonan\u00e9 sp\u00f4sobom,<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>ktor\u00fd umo\u017e\u0148uje overi\u0165 \u00fa\u010das\u0165 vlastn\u00edkov bytov alebo nebytov\u00fdch priestorov v dome na hlasovan\u00ed vylu\u010duj\u00faci ak\u00fako\u013evek zamenite\u013enos\u0165,<\/li>\n\n\n\n<li>z ktor\u00e9ho je zrejm\u00fd a ur\u010dit\u00fd prejav v\u00f4le vlastn\u00edka bytu alebo nebytov\u00e9ho priestoru v dome pri hlasovan\u00ed o konkr\u00e9tnej ot\u00e1zke a<\/li>\n\n\n\n<li>ktor\u00fd zabezpe\u010d\u00ed ochranu hlasovania a jeho v\u00fdsledkov pred neopr\u00e1vnen\u00fdm z\u00e1sahom.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/spravca-bytoveho-domu-a-gdpr\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/spravca-bytoveho-domu-a-gdpr\/\">Spr\u00e1vca bytov\u00e9ho domu a GDPR<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Opakovan\u00e9 hlasovanie<\/strong><\/h2>\n\n\n\n<p>Pod\u013ea \u00a7 14a ods. 7 z\u00e1kona o vlastn\u00edctve bytov a nebytov\u00fdch priestorov: Ak vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome pri p\u00edsomnom hlasovan\u00ed elektronicky hlasuje o jednej veci viackr\u00e1t, za platn\u00fd prejav v\u00f4le sa pova\u017euje elektronick\u00e9 hlasovanie vykonan\u00e9 v r\u00e1mci p\u00edsomn\u00e9ho hlasovania ako posledn\u00e9.
