P\u00edsomn\u00fa formu z\u00e1kon vy\u017eaduje iba v&nbsp;pr\u00edpadoch, kedy s\u00fa predmetom z\u00e1meny nehnute\u013enosti.<\/p>\n\n\n\n<p>Z&nbsp;obsahov\u00fdch n\u00e1le\u017eitost\u00ed odpor\u00fa\u010dame v z\u00e1mennej zmluve zakotvi\u0165 najm\u00e4:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>vymedzenie zamie\u0148aj\u00facich,<\/li>\n\n\n\n<li>vymedzenie zamie\u0148an\u00fdch vec\u00ed,<\/li>\n\n\n\n<li>dojednanie z\u00e1v\u00e4zku jedn\u00e9ho zamie\u0148aj\u00faceho odovzda\u0165 zamie\u0148an\u00fa vec druh\u00e9mu zamie\u0148aj\u00facemu a&nbsp;z\u00e1v\u00e4zku druh\u00e9ho zamie\u0148aj\u00faceho zamie\u0148an\u00fa vec od prv\u00e9ho zamie\u0148aj\u00faceho prevzia\u0165 a&nbsp;naopak,<\/li>\n\n\n\n<li>\u00faprava prechodu rizika \u0161kody na zamie\u0148an\u00fdch veciach,<\/li>\n\n\n\n<li>odovzdanie a&nbsp;prevzatie zamie\u0148an\u00fdch vec\u00ed,<\/li>\n\n\n\n<li>\u00faprava zodpovednosti za vady zamie\u0148an\u00fdch vec\u00ed,<\/li>\n\n\n\n<li>vyhl\u00e1senia a&nbsp;z\u00e1ruky zamie\u0148aj\u00facich t\u00fdkaj\u00face sa&nbsp; zamie\u0148an\u00fdch vec\u00ed (napr. oh\u013eadom vymienen\u00fdch vlastnost\u00ed vec\u00ed),<\/li>\n\n\n\n<li>dojednanie d\u00f4vodov na odst\u00fapenie od zmluvy,<\/li>\n\n\n\n<li>\u010fal\u0161ie n\u00e1le\u017eitosti pod\u013ea konkr\u00e9tnych okolnost\u00ed.<\/li>\n<\/ul>\n\n\n\n<p>Ak s\u00fa predmetom z\u00e1meny nehnute\u013enosti, tak v z\u00e1mennej zmluve musia by\u0165 zapracovan\u00e9 v\u0161etky n\u00e1le\u017eitosti, ktor\u00e9 pr\u00e1vny poriadok vy\u017eaduje pod\u013ea katastr\u00e1lneho z\u00e1kona a v pr\u00edpade bytov aj pod\u013ea z\u00e1kona o vlastn\u00edctve bytov a nebytov\u00fdch priestorov.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zmiesana-zmluva\"><strong>Zmie\u0161an\u00e1 zmluva<\/strong><\/h2>\n\n\n\n<p>V&nbsp;niektor\u00fdch pr\u00edpadoch sa m\u00f4\u017ee sta\u0165, \u017ee niektor\u00e1 zo zamie\u0148an\u00fdch vec\u00ed m\u00e1 vy\u0161\u0161iu hodnotu ako vec, za ktor\u00fa sa m\u00e1 zamie\u0148a\u0165. Pre tak\u00e9to pr\u00edpady je mo\u017en\u00e9 dohodn\u00fa\u0165 sa aj na dorovnan\u00ed hodnoty rozdielu vec\u00ed v&nbsp;peniazoch. V&nbsp;takomto pr\u00edpade v\u0161ak u\u017e nep\u00f4jde o&nbsp;z\u00e1menn\u00fa zmluvu, ale o&nbsp;tzv. zmie\u0161an\u00fa zmluvu v&nbsp;zmysle \u00a7 491 Ob\u010dianskeho z\u00e1konn\u00edka.<\/p>\n\n\n\n<p>Pod\u013ea \u00a7 491 ods. 1 a&nbsp;3 Ob\u010dianskeho z\u00e1konn\u00edka: \u201eZ\u00e1v\u00e4zky vznikaj\u00fa najm\u00e4 zo zml\u00fav t\u00fdmto z\u00e1konom v\u00fdslovne upraven\u00fdch; m\u00f4\u017eu v\u0161ak vznika\u0165 aj z in\u00fdch zml\u00fav v z\u00e1kone neupraven\u00fdch (\u00a7 51) a zo zmie\u0161an\u00fdch zml\u00fav obsahuj\u00facich prvky r\u00f4znych zml\u00fav.\u201c \u201eNa z\u00e1v\u00e4zky zo zmie\u0161anej zmluvy treba primerane pou\u017ei\u0165 ustanovenia z\u00e1kona upravuj\u00face z\u00e1v\u00e4zky, ktor\u00e9 sa zmluvou zakladaj\u00fa, pokia\u013e samotn\u00e1 zmluva neur\u010duje inak.\u201c<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zamena-pozemkov-so-Slovenskym-pozemkovym-fondom\"><strong>Z\u00e1mena pozemkov so Slovensk\u00fdm pozemkov\u00fdm fondom<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Z\u00e1meny pozemkov realizovan\u00e9 <a href=\"https:\/\/pozfond.sk\/\" data-type=\"link\" data-id=\"https:\/\/pozfond.sk\/\">Slovak Land Fund<\/a> (\u010falej ako \u201eSPF\u201c) upravuje Nariadenie vl\u00e1dy SR \u010d. 238\/2010 Z. z. ktor\u00fdm sa ustanovuj\u00fa podrobnosti o podmienkach prenaj\u00edmania, predaja, z\u00e1meny a nadob\u00fadania nehnute\u013enost\u00ed Slovensk\u00fdm pozemkov\u00fdm fondom v \u00a7 4.<\/p>\n\n\n\n<p>SPF m\u00f4\u017ee pozemok vo vlastn\u00edctve \u0161t\u00e1tu zamie\u0148a\u0165 za pozemok in\u00fdch vlastn\u00edkov len v r\u00e1mci okresu, ak osobitn\u00fd predpis neustanovuje inak. K&nbsp;z\u00e1mene m\u00f4\u017ee d\u00f4js\u0165 z&nbsp;d\u00f4vodu:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>vyporiadania podielov\u00e9ho spoluvlastn\u00edctva, ak m\u00e1 pozemok okrem \u0161t\u00e1tu len jedn\u00e9ho spoluvlastn\u00edka, ktor\u00fd vlastn\u00ed nadpolovi\u010dn\u00fd podiel, a nie je mo\u017en\u00e9 alebo pre fond \u00fa\u010deln\u00e9 rozdelenie pozemku,<\/li>\n\n\n\n<li>zabezpe\u010denia pr\u00edstupu k nehnute\u013enostiam,<\/li>\n\n\n\n<li>nadobudnutia pozemkov do vlastn\u00edctva \u0161t\u00e1tu na uspokojovanie re\u0161titu\u010dn\u00fdch n\u00e1rokov opr\u00e1vnen\u00fdch os\u00f4b pod\u013ea osobitn\u00e9ho predpisu alebo ak \u0161t\u00e1t potrebuje pozemky na plnenie \u00faloh pod\u013ea osobitn\u00fdch predpisov,<\/li>\n\n\n\n<li>zalo\u017eenia trval\u00fdch porastov pri splnen\u00ed podmienok pod\u013ea \u00a7 2 ods. 6,<\/li>\n\n\n\n<li>usporiadania vlastn\u00edctva k pozemkom v zastavan\u00fdch are\u00e1loch po\u013enohospod\u00e1rskych podnikov alebo spr\u00e1vcov lesn\u00e9ho majetku \u0161t\u00e1tu, ako aj k pozemkom zastavan\u00fdm in\u00fdmi stavbami ur\u010den\u00fdmi na \u00fa\u010dely po\u013enohospod\u00e1rstva alebo lesn\u00e9ho hospod\u00e1rstva,<\/li>\n\n\n\n<li>nadobudnutia pozemkov v chr\u00e1nen\u00fdch \u00fazemiach do vlastn\u00edctva \u0161t\u00e1tu na \u00fa\u010dely ochrany pr\u00edrody a krajiny.<\/li>\n<\/ol>\n\n\n\n<p>Pozemky, ktor\u00e9 s\u00fa z&nbsp;uveden\u00fdch d\u00f4vodov zamie\u0148an\u00e9 musia by\u0165 porovnate\u013en\u00e9. Porovnate\u013enos\u0165 sa posudzuje najm\u00e4 pod\u013ea polohy, ve\u013ekosti, tvaru, druhu a hodnoty pozemkov.
