Pod\u013ea z\u00e1kona o niektor\u00fdch opatreniach na usporiadanie vlastn\u00edctva k pozemkom nem\u00f4\u017ee na z\u00e1klade pr\u00e1vneho \u00fakonu alebo rozhodnutia s\u00fadu o vyporiadan\u00ed spoluvlastn\u00edctva alebo rozhodnutia o dedi\u010dstve vznikn\u00fa\u0165 rozdelen\u00edm jestvuj\u00facich pozemkov pozemok men\u0161\u00ed ako 3 000 m<sup>2<\/sup>for agricultural land or smaller than 5,000 m<sup>2<\/sup>for forest land.<\/p>\n\n\n\n<p>Pod\u013ea z\u00e1kona o ochrane a vyu\u017e\u00edvan\u00ed po\u013enohospod\u00e1rskej p\u00f4dy je po\u013enohospod\u00e1rskou p\u00f4dou produk\u010dne potenci\u00e1lna p\u00f4da evidovan\u00e1 v katastri nehnute\u013enost\u00ed ako orn\u00e1 p\u00f4da, chme\u013enice, vinice, ovocn\u00e9 sady, z\u00e1hrady a trval\u00e9 tr\u00e1vne porasty.<\/p>\n\n\n\n<p>V\u017edy odpor\u00fa\u010dame zv\u00e1\u017ei\u0165, \u010di vzh\u013eadom na v\u00fdmeru, tvar pozemku, polohu at\u010f. rozdelen\u00edm ned\u00f4jde k&nbsp;jeho znehodnoteniu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Predkupn\u00e9 pr\u00e1vo podielov\u00e9ho spoluvlastn\u00edka<\/strong><\/h2>\n\n\n\n<p>Upozor\u0148ujeme, \u017ee v&nbsp;pr\u00edpade uzatv\u00e1rania dohody o&nbsp;zru\u0161en\u00ed a&nbsp;vyporiadan\u00ed podielov\u00e9ho spoluvlastn\u00edctva musia by\u0165 \u00fa\u010dastn\u00edkmi dohody v\u0161etci podielov\u00ed spoluvlastn\u00edci. V&nbsp;niektor\u00fdch pr\u00edpadoch v&nbsp;z\u00e1vislosti od konkr\u00e9tnych okolnost\u00ed v\u0161ak pre v\u00e1m m\u00f4\u017ee by\u0165 dostato\u010dn\u00fdm rie\u0161en\u00edm aj z\u00edskanie iba \u010dasti spoluvlastn\u00edckych podielov, napr. k\u00fapou podielov od \u010dasti podielov\u00fdch spoluvlastn\u00edkov. Upozor\u0148ujeme, \u017ee aj v&nbsp;tak\u00fdchto pr\u00edpadoch je potrebn\u00e9 pam\u00e4ta\u0165 na z\u00e1konn\u00e9 predkupn\u00e9 pr\u00e1vo podielov\u00e9ho spoluvlastn\u00edka. Odpor\u00fa\u010dame preto, aby ste sa uistili, \u017ee podiely, ktor\u00e9 by ste tak\u00fdmto sp\u00f4sobom nadob\u00fadali boli za rovnak\u00fdch podmienok preuk\u00e1zate\u013ene pon\u00faknut\u00e9 aj ostatn\u00fdm podielov\u00fdm spoluvlastn\u00edkom.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/premlcanie-narokov-z-porusenia-predkupneho-prava\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/premlcanie-narokov-z-porusenia-predkupneho-prava\/\">Preml\u010danie n\u00e1rokov z poru\u0161enia z\u00e1konn\u00e9ho predkupn\u00e9ho pr\u00e1va podielov\u00e9ho spoluvlastn\u00edctva<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Byty, nebytov\u00e9 priestory, spolo\u010dn\u00e9 \u010dasti, zariadenia a pr\u00edslu\u0161enstvo bytov\u00e9ho domu a\u00a0vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva<\/strong><\/h2>\n\n\n\n<p>Spolo\u010dn\u00e9 \u010dasti, zariadenia a&nbsp;pr\u00edslu\u0161enstvo bytov\u00fdch domov s\u00fa v podielovom spoluvlastn\u00edctve vlastn\u00edkov bytov a nebytov\u00fdch priestorov.<\/p>\n\n\n\n<p>Pod\u013ea \u00a7 13, ods. 1, 2 z\u00e1kona o&nbsp;vlastn\u00edctve bytov a&nbsp;nebytov\u00fdch priestorov: \u201eS vlastn\u00edctvom bytu a nebytov\u00e9ho priestoru v dome je <strong>nerozlu\u010dne spojen\u00e9<\/strong> spoluvlastn\u00edctvo spolo\u010dn\u00fdch \u010dast\u00ed domu, spolo\u010dn\u00fdch zariaden\u00ed domu, pr\u00edslu\u0161enstva a spoluvlastn\u00edctvo alebo in\u00e9 spolo\u010dn\u00e9 pr\u00e1va k pozemku.\u201c<\/p>\n\n\n\n<p>\u201eSpoluvlastn\u00edci spolo\u010dn\u00fdch \u010dast\u00ed domu, spolo\u010dn\u00fdch zariaden\u00ed domu, pr\u00edslu\u0161enstva a pozemku <strong>sa nem\u00f4\u017eu do\u017eadova\u0165 zru\u0161enia spoluvlastn\u00edctva<\/strong> pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka.<\/p>\n\n\n\n<p>Pod\u013ea rozsudku Najvy\u0161\u0161ieho s\u00fadu SR z 29. 11. 2005 sp. zn. 4 Cdo 9\/2005, R 26\/2007: \u201ePozemkom v zmysle ustanovenia \u00a7 13 ods. 2 z\u00e1kona \u010d. 182\/1993 Z. z. o vlastn\u00edctve bytov a nebytov\u00fdch priestorov, ku ktor\u00e9mu sa spoluvlastn\u00edci nem\u00f4\u017eu do\u017eadova\u0165 zru\u0161enia spoluvlastn\u00edctva pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka, treba rozumie\u0165 nielen pozemok zastavan\u00fd bytov\u00fdm domom, ale aj pri\u013eahl\u00fd pozemok.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Spolo\u010dn\u00e9 nehnute\u013enosti a\u00a0vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva<\/strong><\/h2>\n\n\n\n<p>Spolo\u010dnou nehnute\u013enos\u0165ou sa rozumie jedna nehnute\u013en\u00e1 vec, ktor\u00e1 m\u00f4\u017ee pozost\u00e1va\u0165 z viacer\u00fdch pozemkov a na ktor\u00fa sa vz\u0165ahovali osobitn\u00e9 predpisy. Podielov\u00e9 spoluvlastn\u00edctvo spolo\u010dnej nehnute\u013enosti mo\u017eno zru\u0161i\u0165 a vyporiada\u0165 iba pod\u013ea \u00fapravy zahrnutej v&nbsp;z\u00e1kone o pozemkov\u00fdch \u00faprav\u00e1ch, usporiadan\u00ed pozemkov\u00e9ho vlastn\u00edctva, pozemkov\u00fdch \u00faradoch, pozemkovom fonde a o pozemkov\u00fdch spolo\u010denstv\u00e1ch.<\/p>\n\n\n\n<p>Od pozemku alebo pozemkov patriacich do spolo\u010dnej nehnute\u013enosti (urb\u00e1re, pasienkov\u00e9 spolo\u010denstv\u00e1) mo\u017eno na z\u00e1klade rozhodnutia spoluvlastn\u00edkov spolo\u010dnej nehnute\u013enosti na zhroma\u017eden\u00ed oddeli\u0165 novovytvoren\u00fd pozemok. Oddelen\u00e1 \u010das\u0165 spolo\u010dnej nehnute\u013enosti prest\u00e1va by\u0165 spolo\u010dnou nehnute\u013enos\u0165ou d\u0148om z\u00e1pisu v katastri nehnute\u013enost\u00ed. Oddelen\u00e1 \u010das\u0165 spolo\u010dnej nehnute\u013enosti sa st\u00e1va spolo\u010dne obhospodarovanou nehnute\u013enos\u0165ou, ak jej vlastn\u00edci nerozhodn\u00fa inak.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nezru\u0161enie podielov\u00e9ho spoluvlastn\u00edctva z\u00a0d\u00f4vodu hodn\u00e9ho osobitn\u00e9ho zrete\u013ea<\/strong><\/h2>\n\n\n\n<p>Ani podanie \u017ealoby o&nbsp;zru\u0161enie a&nbsp;vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva nemus\u00ed v&nbsp;ka\u017edom pr\u00edpade znamena\u0165, \u017ee sa v\u00e1m zru\u0161enie podielov\u00e9ho spoluvlastn\u00edctva aj naozaj podar\u00ed dosiahnu\u0165. Z\u00e1kon v ur\u010dit\u00fdch situ\u00e1ci\u00e1ch umo\u017e\u0148uje, aby s\u00fad podielov\u00e9 spoluvlastn\u00edctvo nezru\u0161il a nevyporiadal.<\/p>\n\n\n\n<p>Tak\u00fdmto sp\u00f4sobom m\u00f4\u017ee s\u00fad postupova\u0165 v pr\u00edpade, \u017ee by sa vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva malo uskuto\u010dni\u0165 prik\u00e1zan\u00edm veci jedn\u00e9mu alebo viacer\u00fdm zo spoluvlastn\u00edkov za n\u00e1hradu alebo predajom veci a rozdelen\u00edm v\u00fd\u0165a\u017eku, nie v pr\u00edpade re\u00e1lneho rozdelenia veci. Aj je teda mo\u017en\u00e9, aby s\u00fad rozhodol o rozdelen\u00ed veci, nem\u00f4\u017ee s\u00fad rozhodn\u00fa\u0165 o nezru\u0161en\u00ed podielov\u00e9ho spoluvlastn\u00edctva z d\u00f4vodu hodn\u00e9ho osobitn\u00e9ho zrete\u013ea, ale podielov\u00e9 spoluvlastn\u00edctvo mus\u00ed zru\u0161i\u0165 a vyporiada\u0165 rozdelen\u00edm veci.<\/p>\n\n\n\n<p>Pr\u00e1vny poriadok bli\u017e\u0161ie nezakotvuje, \u010do je mo\u017en\u00e9 pova\u017eova\u0165 za d\u00f4vod hodn\u00fd osobitn\u00e9ho zrete\u013ea, ur\u010dit\u00e9 d\u00f4vody, ktor\u00e9 s\u00fa s\u00fadmi akceptovan\u00e9 s\u00fa v\u0161ak priebe\u017ene formulovan\u00e9 v rozhodovacej praxi s\u00fadov.
