Pod\u013ea \u00a7 142 ods. 2 Ob\u010dianskeho z\u00e1konn\u00edka: \u201eAk ned\u00f4jde k dohode, zru\u0161\u00ed spoluvlastn\u00edctvo a vykon\u00e1 vyporiadanie na n\u00e1vrh niektor\u00e9ho spoluvlastn\u00edka s\u00fad. Prihliadne pritom na ve\u013ekos\u0165 podielov a na \u00fa\u010deln\u00e9 vyu\u017eitie veci. Ak nie je rozdelenie veci dobre mo\u017en\u00e9, prik\u00e1\u017ee s\u00fad vec za primeran\u00fa n\u00e1hradu jedn\u00e9mu alebo viacer\u00fdm spoluvlastn\u00edkom. S\u00fad prihliadne pritom na to, aby sa vec mohla \u00fa\u010delne vyu\u017ei\u0165 a na n\u00e1siln\u00e9 spr\u00e1vanie podielov\u00e9ho spoluvlastn\u00edka vo\u010di ostatn\u00fdm spoluvlastn\u00edkom. Ak vec \u017eiadny zo spoluvlastn\u00edkov nechce, s\u00fad nariadi jej predaj a v\u00fd\u0165a\u017eok rozdel\u00ed pod\u013ea podielov.\u201c<\/p>\n\n\n\n<p>Z&nbsp;uveden\u00e9ho ustanovenia vypl\u00fdva, \u017ee s\u00fad v prvom rade sk\u00fama, \u010di je mo\u017en\u00e9 pozemok rozdeli\u0165, a\u017e n\u00e1sledne, ak rozdelenie nie je dobre mo\u017en\u00e9, prik\u00e1\u017ee vec niektor\u00e9mu alebo viacer\u00fdm zo spoluvlastn\u00edkov a&nbsp;a\u017e v&nbsp;pr\u00edpade, \u017ee nik zo spoluvlastn\u00edkov nem\u00e1 z\u00e1ujem nadobudn\u00fa\u0165 vec do v\u00fdlu\u010dn\u00e9ho vlastn\u00edctva nariadi predaj pozemku a rozdelenie v\u00fd\u0165a\u017eku. V&nbsp;pr\u00edpade dohody spoluvlastn\u00edkov tak\u00e9to poradie mo\u017enost\u00ed nezav\u00e4zuje.<\/p>\n\n\n\n<p>The law allows the court, for reasons worthy of special consideration, not to cancel joint ownership. In addition, when cancelling and settling joint ownership by dividing the property, the court may establish an encumbrance on the newly created property in favour of the owner of another newly created property.<\/p>\n\n\n\n<p>Pod\u013ea rozsudku R 54\/1973: \u201ePoradie a&nbsp;podmienky pou\u017eitia jednotliv\u00fdch sp\u00f4sobov zru\u0161enia a&nbsp;vyporiadania spoluvlastn\u00edctva s\u00fa pre s\u00fady z\u00e1v\u00e4zn\u00e9, a&nbsp;s\u00fady, pokia\u013e o&nbsp; zru\u0161en\u00ed spoluvlastn\u00edctva rozhoduj\u00fa rozsudkom, ich aj re\u0161pektuj\u00fa. Ak v\u0161ak \u00fa\u010dastn\u00edci uzavieraj\u00fa v&nbsp; konan\u00ed o&nbsp; zru\u0161enie spoluvlastn\u00edctva zmier, ktor\u00fdm si sami zvolia ur\u010dit\u00fd sp\u00f4sob zru\u0161enia a&nbsp;vyporiadania spoluvlastn\u00edctva, s\u00fady pri rozhodovan\u00ed a&nbsp;schv\u00e1len\u00ed uzavret\u00e9ho zmieru nepova\u017euj\u00fa za prek\u00e1\u017eku z&nbsp;schv\u00e1lenia t\u00fa okolnos\u0165, \u017ee by pr\u00edpadne bolo mo\u017en\u00e9 vyporiadanie aj in\u00fdm sp\u00f4sobom, ne\u017e ako sa v&nbsp;zmieri navrhuje, a&nbsp;to sp\u00f4sobom, ktor\u00e9mu z\u00e1kon d\u00e1va prednos\u0165. To, pravda\u017ee, plat\u00ed iba pre pr\u00edpad, \u017ee dohoda \u00fa\u010dastn\u00edkov m\u00e1 procesn\u00fa formu zmieru. Prost\u00fd s\u00fahlas \u00fa\u010dastn\u00edkov s&nbsp;navrhovan\u00fdm sp\u00f4sobom vyporiadania v\u0161ak nenahradzuje zmier. Tak\u00fdmto sp\u00f4sobom m\u00f4\u017ee s\u00fad postupova\u0165 v&nbsp;pr\u00edpade, \u017ee by sa vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva malo uskuto\u010dni\u0165 prik\u00e1zan\u00edm veci jedn\u00e9mu alebo viacer\u00fdm zo spoluvlastn\u00edkov za n\u00e1hradu alebo predajom veci a&nbsp;rozdelen\u00edm v\u00fd\u0165a\u017eku, nie v&nbsp;pr\u00edpade re\u00e1lneho rozdelenia veci. Aj je teda mo\u017en\u00e9, aby s\u00fad rozhodol o&nbsp;rozdelen\u00ed veci, nem\u00f4\u017ee s\u00fad rozhodn\u00fa\u0165 o&nbsp;nezru\u0161en\u00ed podielov\u00e9ho spoluvlastn\u00edctva z&nbsp;d\u00f4vodu hodn\u00e9ho osobitn\u00e9ho zrete\u013ea, ale podielov\u00e9 spoluvlastn\u00edctvo mus\u00ed zru\u0161i\u0165 a&nbsp;vyporiada\u0165 rozdelen\u00edm veci.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>D\u00f4vody hodn\u00e9 osobitn\u00e9ho zrete\u013ea pre nezru\u0161enie podielov\u00e9ho spoluvlastn\u00edctva<\/strong><\/h2>\n\n\n\n<p>Pr\u00e1vny poriadok bli\u017e\u0161ie nezakotvuje, \u010do je mo\u017en\u00e9 pova\u017eova\u0165 za d\u00f4vod hodn\u00fd osobitn\u00e9ho zrete\u013ea, ur\u010dit\u00e9 d\u00f4vody, ktor\u00e9 s\u00fa s\u00fadmi akceptovan\u00e9 s\u00fa v\u0161ak priebe\u017ene formulovan\u00e9 v rozhodovacej praxi s\u00fadov.<\/p>\n\n\n\n<p>Be\u017ene ide napr. o&nbsp;situ\u00e1cie, kedy je spolo\u010dnou vecou nehnute\u013enos\u0165, v&nbsp;ktorej b\u00fdva star\u0161\u00ed \u010dlovek, ktor\u00fd v&nbsp;nehnute\u013enosti b\u00fdval dlhodobou, m\u00e1 k&nbsp;nej citov\u00fd vz\u0165ah a&nbsp;z&nbsp;d\u00f4vodu veku a \/ alebo zdravotn\u00e9ho stavu m\u00e1 probl\u00e9m zabezpe\u010di\u0165 si in\u00e9 b\u00fdvanie alebo nehnute\u013enos\u0165 je domovom malolet\u00e9ho die\u0165a\u0165a a&nbsp;podobne.<\/p>\n\n\n\n<p>Pod\u013ea rozsudku Najvy\u0161\u0161ieho s\u00fadu SR, sp. zn. 4 Cdo 137\/97 (publikovan\u00fd v&nbsp;Zbierke: R 100\/1999): \u201eD\u00f4vodmi hodn\u00fdmi osobitn\u00e9ho zrete\u013ea, pre ktor\u00e9 s\u00fad nezru\u0161\u00ed a&nbsp; nevyporiada podielov\u00e9 spoluvlastn\u00edctvo pod\u013ea \u00a7&nbsp; 142 ods. 2 Ob\u010dianskeho z\u00e1konn\u00edka, s\u00fa okolnosti preva\u017ene subjekt\u00edvneho charakteru tak na strane \u017ealovan\u00e9ho (najm\u00e4 jeho zdravotn\u00fd stav, vek a&nbsp;soci\u00e1lna situ\u00e1cia, stav jeho odk\u00e1zanosti na b\u00fdvanie v&nbsp;spornej nehnute\u013enosti, nedostatok mo\u017enost\u00ed uspokoji\u0165 bytov\u00e9 potreby inde, osobn\u00e9 v\u00e4zby na nehnute\u013enos\u0165), ako aj na strane \u017ealobcu (najm\u00e4 ak mu ide len o&nbsp;vyrie\u0161enie u\u017e\u00edvac\u00edch vz\u0165ahov, pri\u010dom ot\u00e1zka z\u00e1niku spoluvlastn\u00edctva nem\u00e1 pre neho prioritu alebo \u017ee vec m\u00e1 v&nbsp;\u00famysle preda\u0165).\u201c<\/p>\n\n\n\n<p>Pod\u013ea rozsudku Krajsk\u00e9ho s\u00fadu v&nbsp;Banskej Bystrici d\u00f4vodom hodn\u00fdm osobitn\u00e9ho zrete\u013ea <strong>nebolo <\/strong>napr. mo\u017en\u00e9 bud\u00face napojenie sa na in\u017einierske siete. \u201eK od\u00f4vodneniu rozsudku s\u00fadu prvej in\u0161tancie, ktor\u00fd videl d\u00f4vody hodn\u00e9 osobitn\u00e9ho zrete\u013ea pre zamietnutie n\u00e1vrhu na zru\u0161enie a vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva pod\u013ea \u00a7 142 ods. 2 OZ aj s poukazom na mo\u017en\u00e9 bud\u00face napojenie sa na in\u017einierske siete zo strany \u017ealovan\u00e9ho, na ktor\u00e9 v s\u00fa\u010dasnosti napojen\u00fd nie je, odvolac\u00ed s\u00fad pova\u017euje za nutn\u00e9 pouk\u00e1za\u0165 na rozsudok Najvy\u0161\u0161ieho s\u00fadu SR sp. zn. 2Cdo\/78\/92 zo d\u0148a 27.11.1992, v zmysle ktor\u00e9ho \u201eskuto\u010dnosti, na z\u00e1klade ktor\u00fdch by bolo mo\u017eno tak\u00e9to osobitn\u00e9ho zrete\u013ea hodn\u00e9 d\u00f4vody pre zamietnutie n\u00e1vrhu vyvodi\u0165, musia v\u0161ak existova\u0165 u\u017e v \u010dase vyhl\u00e1senia tak\u00e9hoto rozhodnutia a musia vypl\u00fdva\u0165 zo skutkov\u00e9ho stavu ust\u00e1len\u00e9ho s\u00fadom k tomuto okamihu\u201c. Na skuto\u010dnos\u0165, \u017ee \u017ealovan\u00fd sa mo\u017eno v bud\u00facnosti na in\u017einierske siete pripoj\u00ed preto nebolo mo\u017en\u00e9 prihliadnu\u0165 ako na d\u00f4vod hodn\u00fd osobitn\u00e9ho zrete\u013ea pre zamietnutie \u017ealoby \u017ealobcov.\u201c (zdroj epi.sk)<\/p>\n\n\n\n<p>Pod\u013ea uznesenia Najvy\u0161\u0161ieho s\u00fadu SR zo 14. novembra 2013 sp. zn. 6 Cdo 279\/2012,&nbsp; R 136\/2014: \u201eD\u00f4vodom hodn\u00fdm osobitn\u00e9ho zrete\u013ea, pre ktor\u00fd s\u00fad nezru\u0161\u00ed a nevyporiada podielov\u00e9 spoluvlastn\u00edctvo prik\u00e1zan\u00edm veci alebo jej predajom a rozdelen\u00edm v\u00fd\u0165a\u017eku (\u00a7 142 ods. 2 Ob\u010dianskeho z\u00e1konn\u00edka), m\u00f4\u017ee by\u0165 aj skuto\u010dnos\u0165, \u017ee <strong>v dotknutej nehnute\u013enosti m\u00e1 malolet\u00e9 die\u0165a spoluvlastn\u00edkov vytvoren\u00fd svoj domov<\/strong>.\u201c<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Costs of legal proceedings<\/strong><\/h2>\n\n\n\n<p>Mnoh\u00fdch klientov pri rozhodovan\u00ed o \u010fal\u0161om postupe zauj\u00edmaj\u00fa n\u00e1klady. \u010co sa t\u00fdka n\u00e1kladov na s\u00fadne konanie, treba po\u010d\u00edta\u0165 s&nbsp;\u00fahradou s\u00fadneho poplatku r\u00e1dovo v&nbsp;desiatkach eur (pod\u013ea aktu\u00e1lneho sadzobn\u00edka)<\/p>\n\n\n\n<p>\u010ealej bude potrebn\u00fd znaleck\u00fd posudok na ur\u010denie hodnoty spolo\u010dnej veci. Bu\u010f si m\u00f4\u017eete da\u0165 vypracova\u0165 (a zaplati\u0165) s\u00fakromn\u00fd znaleck\u00fd posudok e\u0161te pred podan\u00edm \u017ealoby alebo m\u00f4\u017eete navrhn\u00fa\u0165, aby s\u00fad ustanovil znalca. Ak navrhnete ustanovenie znalca s\u00fadom, s\u00fad v\u00e1s vyzve na zlo\u017eenie preddavku na trovy znaleck\u00e9ho dokazovania.
