Podpis darcu mus\u00ed by\u0165 \u00faradne osved\u010den\u00fd. Pri hnute\u013enej veci mus\u00ed by\u0165 darovacia zmluva p\u00edsomn\u00e1, ak ned\u00f4jde k odovzdaniu a prevzatiu veci pri darovan\u00ed.<\/p>\n\n\n\n<p>Z\u00e1kladn\u00fdmi n\u00e1le\u017eitos\u0165ami darovacej zmluvy s\u00fa:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>vymedzenie zmluvn\u00fdch str\u00e1n &#8211; darcu a&nbsp;obdarovan\u00e9ho<\/li>\n\n\n\n<li>vymedzenie daru<\/li>\n\n\n\n<li>z\u00e1v\u00e4zok darcu previes\u0165 dar na darcu a&nbsp;z\u00e1v\u00e4zok obdarovan\u00e9ho dar prija\u0165<\/li>\n\n\n\n<li>podpis darcu a&nbsp;obdarovan\u00e9ho.<\/li>\n<\/ul>\n\n\n\n<p>Upozor\u0148ujeme, \u017ee obdarovan\u00fd mus\u00ed s&nbsp;darovan\u00edm s\u00fahlasi\u0165 a&nbsp;preto darovacia zmluva mus\u00ed obsahova\u0165 v\u017edy aj podpis obdarovan\u00e9ho \u2013 ide o&nbsp;dvojstrann\u00fd pr\u00e1vny \u00fakon.<\/p>\n\n\n\n<p>Okrem vy\u0161\u0161ie uveden\u00fdch n\u00e1le\u017eitost\u00ed odpor\u00fa\u010dame do znenia darovacej zmluvy zapracova\u0165 aj \u010fal\u0161ie n\u00e1le\u017eitosti, ako napr.:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>upozornenie darcu na vady daru (v tejto s\u00favislosti upozor\u0148ujeme, \u017ee darca je povinn\u00fd pri ponuke daru upozorni\u0165 na vady, o ktor\u00fdch vie. Ak m\u00e1 vec vady, na ktor\u00e9 darca neupozornil, je obdarovan\u00fd opr\u00e1vnen\u00fd vec vr\u00e1ti\u0165),<\/li>\n\n\n\n<li>dojednania t\u00fdkaj\u00face sa odovzdania daru,<\/li>\n\n\n\n<li>in\u00e9 n\u00e1le\u017eitosti pod\u013ea konkr\u00e9tnych okolnost\u00ed.<\/li>\n<\/ul>\n\n\n\n<p>Ak je darom nehnute\u013enos\u0165, tak v&nbsp;darovacej zmluva musia by\u0165 zapracovan\u00e9 v\u0161etky n\u00e1le\u017eitosti, ktor\u00e9 pr\u00e1vny poriadok vy\u017eaduje pod\u013ea katastr\u00e1lneho z\u00e1kona a&nbsp;v&nbsp;pr\u00edpade bytov aj pod\u013ea z\u00e1kona o&nbsp;vlastn\u00edctve bytov a&nbsp;nebytov\u00fdch priestorov.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"darovanie-pre-pripad-smrti\"><strong>Darovanie pre pr\u00edpad smrti<\/strong><\/h2>\n\n\n\n<p>Neplatn\u00e1 je darovacia zmluva, pod\u013ea ktorej sa m\u00e1 plni\u0165 a\u017e po darcovej smrti. Pokia\u013e chce niekto niekomu prenecha\u0165 vec a\u017e po svojej smrti, je mo\u017en\u00e9 sp\u00edsanie z\u00e1vetu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"vratenie-daru\"><strong>Vr\u00e1tenie daru<\/strong><\/h2>\n\n\n\n<p>Pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka sa darca m\u00f4\u017ee dom\u00e1ha\u0165 vr\u00e1tenia daru, ak sa obdarovan\u00fd spr\u00e1va k nemu alebo \u010dlenom jeho rodiny tak, \u017ee t\u00fdm hrubo poru\u0161uje dobr\u00e9 mravy.<\/p>\n\n\n\n<p>Z\u00e1kon bli\u017e\u0161ie ne\u0161pecifikuje, \u010do konkr\u00e9tne m\u00f4\u017ee by\u0165 hrub\u00fdm poru\u0161en\u00edm dobr\u00fdch mravov, ktor\u00e9 by mohlo&nbsp; ma\u0165 za n\u00e1sledok splnenie podmienok pre vr\u00e1tenie daru. D\u00f4le\u017eit\u00e9 inform\u00e1cie&nbsp; o&nbsp;tom, \u010do m\u00f4\u017ee a&nbsp;\u010do nem\u00f4\u017ee by\u0165 d\u00f4vodom na vr\u00e1tenie daru preto vypl\u00fdvaj\u00fa z&nbsp;rozhodovacej praxe s\u00fadov.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pod\u013ea <strong>rozsudku R 31\/1999<\/strong>: \u201ePr\u00e1vo darcu dom\u00e1ha\u0165 sa vr\u00e1tenia daru nevznik\u00e1 pri prostej nev\u010fa\u010dnosti obdarovan\u00e9ho vo\u010di darcovi ani pri menej v\u00fdznamnom poru\u0161en\u00ed dobr\u00fdch mravov zo strany obdarovan\u00e9ho. Za hrub\u00e9 poru\u0161enie dobr\u00fdch mravov obdarovan\u00fdm nemo\u017eno pova\u017eova\u0165 napr\u00edklad predaj darovanej veci cudzej osobe alebo nenav\u0161tevovanie darcu pri pr\u00edle\u017eitosti sviatkov a&nbsp;jeho \u017eivotn\u00fdch jubile\u00ed.\u201c<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pod\u013ea <strong>rozsudku Najvy\u0161\u0161ieho s\u00fadu \u010cR, sp. zn. 33 Cdo 2425\/98<\/strong>: \u201eD\u00e1rce se jako d\u016fvodu k&nbsp; vr\u00e1cen\u00ed daru nem\u016f\u017ee dovol\u00e1vat skutkov\u00fdch okolnost\u00ed, je\u017e nastaly \u010di existovaly v dob\u011b p\u0159ed darov\u00e1n\u00edm a za nich\u017e byl pr\u00e1vn\u00ed \u00fakon u\u010din\u011bn a o nich\u017e ob\u011b strany p\u0159i uzav\u00edr\u00e1n\u00ed smlouvy v\u011bd\u011bly.\u201c<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>V zmysle <strong>uznesenia Najvy\u0161\u0161ieho s\u00fadu \u010cR, sp. zn. 32 Odo 429\/2003<\/strong>: \u201eProml\u010dec\u00ed doba pro uplatn\u011bn\u00ed n\u00e1roku na vr\u00e1cen\u00ed daru po\u010d\u00edn\u00e1 b\u011b\u017eet od okam\u017eiku, kdy chov\u00e1n\u00ed obdarovan\u00e9ho naplnilo znaky uveden\u00e9 v&nbsp;\u00a7&nbsp;630 ob\u010d. z\u00e1k.\u201c<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pod\u013ea <strong>rozsudku Krajsk\u00e9ho s\u00fadu v&nbsp;Tren\u010d\u00edne sp. zn. 4Co\/4\/2019<\/strong>: \u201e&#8230; mal s\u00fad za preuk\u00e1zan\u00e9, \u017ee vz\u0165ah medzi stranami sporu je naru\u0161en\u00fd <strong>v d\u00f4sledku pou\u017e\u00edvania alkoholick\u00fdch n\u00e1pojov \u017ealovan\u00fdm<\/strong>. Pod vplyvom alkoholu doch\u00e1dzalo medzi stranami k h\u00e1dkam, nezhod\u00e1m, k schv\u00e1lnostiam, hrub\u00e9mu spr\u00e1vaniu o \u010dom sved\u010d\u00ed skuto\u010dnos\u0165, \u017ee \u017ealovan\u00fd bol u\u017e 3 x priestupkovo rie\u0161en\u00fd Okresn\u00fdm \u00faradom za priestupky proti ob\u010dianskemu spoluna\u017e\u00edvaniu, ktor\u00fdch sa dopustil vo\u010di \u017ealobkyni a synovi F., \u010do sa nepriaznivo odrazilo aj na zdravotnom stave \u017ealobkyne a jej syna. S\u00fad mal v konan\u00ed za preuk\u00e1zan\u00e9, \u017ee spr\u00e1vanie zo strany \u017ealovan\u00e9ho na adresu \u017ealobkyne a jej syna je opakovan\u00fdm, pretrv\u00e1vaj\u00facim, trval\u00e9ho charakteru a sp\u00f4sobilo, \u017ee \u017ealobky\u0148a vyh\u013eadala odborn\u00fa pomoc z oblasti psychol\u00f3gie a psychiatrie.\u201c .<\/li>\n<\/ul>\n\n\n\n<p>\u201eS\u00fad mal vzh\u013eadom na vy\u0161\u0161ie op\u00edsan\u00e9 skuto\u010dnosti za preuk\u00e1zan\u00e9, \u017ee spr\u00e1vanie \u017ealovan\u00e9ho vo\u010di synovi a \u017ealobkyni je v rozpore s dobr\u00fdmi mravmi a vonkaj\u0161\u00edm prejavom tak\u00e9hoto spr\u00e1vania s\u00fa nielen <strong>fyzick\u00e9 n\u00e1silie, ale aj preuk\u00e1zate\u013en\u00e9 ur\u00e1\u017eky, pou\u017e\u00edvanie vulgarizmov na adresu \u017ealobkyne a jej syna, poni\u017eovanie \u017ealobkyne a jej syna \u010di nez\u00e1ujem o rodinu<\/strong>. S\u00fad mal za to, \u017ee spr\u00e1vanie \u017ealovan\u00e9ho m\u00e1 dopad nielen na zdravie \u017ealobkyne a jej syna, ale takisto sa jedn\u00e1 o konanie, ktor\u00e9 <strong>znehodnocuje majetok, ktor\u00fd je predmetom daru<\/strong> &#8230;\u201c<\/p>\n\n\n\n<p>Poru\u0161enie dobr\u00fdch mravov je v praxi komplikovan\u00e9 preuk\u00e1za\u0165, preto odpor\u00fa\u010dame darovanie dopredu dobe zv\u00e1\u017ei\u0165.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"darovanie-spoluvlastnickeho-podielu\"><strong>Darovanie spoluvlastn\u00edckeho podielu<\/strong><\/h2>\n\n\n\n<p>Vo v\u0161eobecnosti je darovanie mo\u017en\u00e9 aj v&nbsp;pr\u00edpade, \u017ee darom nie je cel\u00e1 vec, ale iba spoluvlastn\u00edcky podiel. V&nbsp;takomto pr\u00edpade v\u0161ak upozor\u0148ujeme na z\u00e1konn\u00e9 predkupn\u00e9 pr\u00e1vo podielov\u00e9ho spoluvlastn\u00edka, ktor\u00e9 sa uplat\u0148uje aj v&nbsp;pr\u00edpade darovania.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/podielove-spoluvlastnictvo\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/podielove-spoluvlastnictvo\/\">Co-ownership<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/spoluvlastnik-nesuhlasi-s-predajom-pozemku-ake-mam-moznosti\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/spoluvlastnik-nesuhlasi-s-predajom-pozemku-ake-mam-moznosti\/\">Spoluvlastn\u00edk nes\u00fahlas\u00ed s predajom pozemku, ak\u00e9 m\u00e1m mo\u017enosti?<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"darovanie-domu-bez-pozemku\"><strong>Je mo\u017en\u00e9 darovanie domu bez pozemku?<\/strong><\/h2>\n\n\n\n<p>Dom a&nbsp;pozemok, na ktorom je dom postaven\u00fd s\u00fa v&nbsp;slovenskom pr\u00e1vnom poriadku dvomi samostatn\u00fdmi vecami, ktor\u00e9 m\u00f4\u017eu, ale nemusia ma\u0165 rovnak\u00e9ho vlastn\u00edka.<\/p>\n\n\n\n<p>V&nbsp;praxi s\u00fa mo\u017en\u00e9 aj situ\u00e1cie, \u017ee darca je vlastn\u00edkom stavby, ale nie pozemku pod stavbou alebo naopak, darca je vlastn\u00edkom pozemku pod stavbou, ale nie vlastn\u00edkom stavby. V&nbsp;takomto pr\u00edpade samozrejme darca m\u00f4\u017ee na obdarovan\u00e9ho previes\u0165, iba t\u00fa nehnute\u013enos\u0165, ktor\u00fa vlastn\u00ed. Takisto je mo\u017en\u00e9, aby darca, ktor\u00fd je aj vlastn\u00edkom stavby, aj vlastn\u00edkom pozemku pod stavbou na obdarovan\u00e9ho previedol iba niektor\u00fa z&nbsp;t\u00fdchto nehnute\u013enost\u00ed. Tak\u00e1to situ\u00e1cia sa m\u00f4\u017ee sta\u0165 aj ne\u00famyselne, napr. tak, \u017ee si darca neuvedom\u00ed, \u017ee v&nbsp;darovacej zmluve ne\u0161pecifikoval aj pozemok alebo neuvedie v\u0161etky parcely (ak s\u00fa zastavan\u00fd pozemok, dvor, z\u00e1hrada a&nbsp;pod. tvoren\u00e9 viacer\u00fdmi parcelami). Odpor\u00fa\u010dame preto dobre skontrolova\u0165, \u010di s\u00fa v&nbsp;darovacej zmluve \u0161pecifikovan\u00e9 v\u0161etky nehnute\u013enosti, ktor\u00e9 sa maj\u00fa previes\u0165.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"darovanie-zatazenej-nehnutenosti\"><strong>Darovanie nehnute\u013enosti za\u0165a\u017eenej hypot\u00e9kou<\/strong><\/h2>\n\n\n\n<p>Mo\u017en\u00e9 je aj darovanie nehnute\u013enosti za\u0165a\u017eenej hypot\u00e9kou. V&nbsp;pr\u00edpade z\u00e1ujmu o&nbsp;darovanie nehnute\u013enosti za\u0165a\u017eenej hypot\u00e9kou v\u0161ak treba po\u010d\u00edta\u0165 s&nbsp;t\u00fdm, \u017ee do splatenia hypot\u00e9ky bude na nehnute\u013enosti viaznu\u0165 z\u00e1lo\u017en\u00e9 pr\u00e1vo v&nbsp;prospech financuj\u00facej banky. Tak\u00e9to situ\u00e1cie odpor\u00fa\u010dame vopred konzultova\u0165 s&nbsp;financuj\u00facou bankou, ke\u010f\u017ee napr. podmienky poskytnutia hypotek\u00e1rneho \u00faveru m\u00f4\u017eu vylu\u010dova\u0165 prevod za\u0165a\u017eenej nehnute\u013enosti na in\u00fa osobu, pri\u010dom poru\u0161enie tak\u00e9hoto obmedzenia m\u00f4\u017ee by\u0165 spojen\u00e9 so sankciami.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zapocitanie-darovania-v-dedicskom-konani\"><strong>Zapo\u010d\u00edtanie darovania v&nbsp;dedi\u010dskom konan\u00ed<\/strong><\/h2>\n\n\n\n<p>Pokia\u013e poru\u010dite\u013e nezanechal z\u00e1vet, s\u00fad \u0161tandardne potvrd\u00ed nadobudnutie dedi\u010dstva pod\u013ea dedi\u010dsk\u00fdch podielov. Pri deden\u00ed zo z\u00e1kona sa dedi\u010dovi do jeho podielu zapo\u010d\u00edta aj to, \u010do za \u017eivota poru\u010dite\u013ea od neho bezplatne dostal, pokia\u013e nejde o obvykl\u00e9 darovania. Darovanie nehnute\u013enosti sa vo v\u0161eobecnosti za obvykl\u00e9 darovanie nepova\u017euje, preto sa \u0161tandardne zapo\u010d\u00edta na dedi\u010dsk\u00fd podiel dedi\u010da. Pokia\u013e ded\u00ed namiesto die\u0165a\u0165a poru\u010dite\u013ea ded\u00ed jeho vn\u00fa\u010da alebo \u010fal\u0161\u00ed potomok zapo\u010d\u00edta sa okrem toho \u010do tak\u00fdto dedi\u010d od poru\u010dite\u013ea za \u017eivota dostal aj to, \u010do od poru\u010dite\u013ea bezplatne dostal dedi\u010dov predok, namiesto ktor\u00e9ho dedi\u010d ded\u00ed.<\/p>\n\n\n\n<p>Upozor\u0148ujeme v\u0161ak, v&nbsp;not\u00e1r, ktor\u00fd dedi\u010dstvo prejedn\u00e1va nem\u00e1 v&nbsp;praxi odkia\u013e vedie\u0165, \u010di poru\u010dite\u013e za \u017eivota niekomu nie\u010do daroval, preto pokia\u013e ostatn\u00ed dedi\u010di chc\u00fa, aby bolo tak\u00e9to darovanie zoh\u013eadnen\u00e9, je potrebn\u00e9, aby not\u00e1ra na darovanie upozornili a&nbsp;\u017eiadali zapo\u010d\u00edtanie daru na podiel dedi\u010da.<\/p>\n\n\n\n<p>Pri deden\u00ed zo z\u00e1vetu treba toto zapo\u010d\u00edtanie urobi\u0165, ak na to dal poru\u010dite\u013e pr\u00edkaz alebo ak by inak obdarovan\u00fd dedi\u010d bol neod\u00f4vodnene zv\u00fdhodnen\u00fd oproti neopomenute\u013en\u00e9mu dedi\u010dovi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"co-pre-vas-mozeme-urobit\"><strong>\u010co pre v\u00e1s m\u00f4\u017eeme urobi\u0165:<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>telefonick\u00e9, online a osobn\u00e9 konzult\u00e1cie k darovaniu a s\u00favisiacim ot\u00e1zkam<\/li>\n\n\n\n<li>vypracovanie pr\u00e1vnych stanov\u00edsk t\u00fdkaj\u00facich sa darovania a s\u00favisiacich ot\u00e1zok<\/li>\n\n\n\n<li>vypracovanie alebo pripomienkovanie darovacej zmluvy<\/li>\n\n\n\n<li>zastupovanie v konan\u00ed o vr\u00e1tenie daru<\/li>\n\n\n\n<li>zastupovanie v dedi\u010dskom konan\u00ed (uplatnenie zapo\u010d\u00edtania daru v dedi\u010dskom konan\u00ed)<\/li>\n\n\n\n<li>napadnutie platnosti darovania<\/li>\n<\/ul>","protected":false},"excerpt":{"rendered":"<p>Donating real estate has several specific features.
