V&nbsp;r\u00e1mci spr\u00e1vy bytov\u00e9ho domu nie v\u017edy doch\u00e1dza ku konsenzu\u00e1lnym rozhodnutiam vlastn\u00edkov, preto z\u00e1kon upravuje prostriedky pr\u00e1vnej ochrany men\u0161inov\u00fdch (prehlasovan\u00fdch) vlastn\u00edkov bytov v&nbsp;bytovom dome.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/spravca-bytoveho-domu-a-gdpr\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/spravca-bytoveho-domu-a-gdpr\/\">Spr\u00e1vca bytov\u00e9ho domu a GDPR<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/elektronicke-hlasovanie-vlastnikov-bytov\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/elektronicke-hlasovanie-vlastnikov-bytov\/\">Electronic voting of apartment owners<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Podanie \u017ealoby<\/h2>\n\n\n\n<p>Pod\u013ea \u00a7 14a ods. 8 z\u00e1kona o vlastn\u00edctve bytov: \u201e<strong>Prehlasovan\u00fd vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome m\u00e1 pr\u00e1vo obr\u00e1ti\u0165 sa do 30 dn\u00ed od ozn\u00e1menia v\u00fdsledku hlasovania na s\u00fad, aby vo veci rozhodol<\/strong>, inak jeho pr\u00e1vo zanik\u00e1. Ak sa vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome nemohol o v\u00fdsledku hlasovania dozvedie\u0165, m\u00e1 pr\u00e1vo obr\u00e1ti\u0165 sa na s\u00fad najnesk\u00f4r do troch mesiacov od ozn\u00e1menia v\u00fdsledku hlasovania, inak jeho pr\u00e1vo zanik\u00e1. Prehlasovan\u00fd vlastn\u00edk bytu alebo nebytov\u00e9ho priestoru v dome sa m\u00f4\u017ee z\u00e1rove\u0148 na pr\u00edslu\u0161nom s\u00fade dom\u00e1ha\u0165 <strong>do\u010dasn\u00e9ho pozastavenia \u00fa\u010dinnosti rozhodnutia<\/strong> vlastn\u00edkov bytov a nebytov\u00fdch priestorov pod\u013ea osobitn\u00e9ho predpisu. Pri rovnosti hlasov, alebo ak sa potrebn\u00e1 v\u00e4\u010d\u0161ina pod\u013ea \u00a7 14b nedosiahne, rozhoduje na n\u00e1vrh ktor\u00e9hoko\u013evek vlastn\u00edka bytu alebo nebytov\u00e9ho priestoru v dome s\u00fad.\u201c<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pr\u00e1vna \u00faprava<\/h2>\n\n\n\n<p>Ide tu o&nbsp;tzv. <strong>\u017ealobu prehlasovan\u00e9ho vlastn\u00edka\/vlastn\u00edkov bytov\u00e9ho domu<\/strong>. Z\u00e1konn\u00e1 \u00faprava tejto \u017ealoby je ve\u013emi stru\u010dn\u00e1. Z\u00e1kon hovor\u00ed len o&nbsp;mo\u017enosti obr\u00e1ti\u0165 sa na s\u00fad, ale nehovor\u00ed \u010doho sa mo\u017eno dom\u00e1ha\u0165 (ako formulova\u0165 \u017ealobn\u00fd petit). Svojou povahou ide o&nbsp;sporov\u00e9 konanie, preto\u017ee sa rie\u0161i spor medzi vlastn\u00edkmi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00f4vody \u017ealoby<\/h2>\n\n\n\n<p>Prijat\u00e9 rozhodnutie mo\u017eno napadn\u00fa\u0165 na z\u00e1klade nasledovn\u00fdch d\u00f4vodov:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>vecn\u00e9 (obsahov\u00e9) nedostatky<\/strong>&nbsp;prijat\u00e9ho rozhodnutia: napr. rozpor so z\u00e1konom alebo rozpor so zmluvou o&nbsp;v\u00fdkone spr\u00e1vy a&nbsp;pod.<\/li>\n\n\n\n<li><strong>form\u00e1lne (procesn\u00e9) nedostatky&nbsp;<\/strong>t\u00fdkaj\u00face sa zvolania a&nbsp;priebehu sch\u00f4dze vlastn\u00edkov (alebo p\u00edsomn\u00e9ho hlasovania) a prijat\u00fdch rozhodnut\u00ed: napr. nedodr\u017eanie z\u00e1konn\u00e9ho postupu zvolania sch\u00f4dze, nedoru\u010denie ozn\u00e1menia o&nbsp;sch\u00f4dzi vlastn\u00edkom v&nbsp;dome a pozv\u00e1nky na sch\u00f4dzu, nedosiahnutie potrebnej v\u00e4\u010d\u0161iny na prijatie konkr\u00e9tneho rozhodnutia, neozn\u00e1menie v\u00fdsledkov hlasovania v&nbsp;z\u00e1konnej lehote, neoverenia podpisu pri p\u00edsomnom hlasovan\u00ed, a&nbsp;pod.<\/li>\n<\/ul>\n\n\n\n<p>\u017dalobn\u00fdm petitom sa \u017ealobcovia v\u00e4\u010d\u0161inou dom\u00e1haj\u00fa vyslovenia neplatnosti, ne\u00fa\u010dinnosti, nepr\u00edpustnosti prijat\u00e9ho rozhodnutia alebo jeho zru\u0161enia.<\/p>\n\n\n\n<p>Mnoho pr\u00e1vnych aspektov tohto typu \u017ealoby vypl\u00fdva zo s\u00fadnych rozhodnut\u00ed. Je potrebn\u00e9 si da\u0165 pozor na to, aby bola \u017ealoba spr\u00e1vne nap\u00edsan\u00e1 a&nbsp;obsahovala v\u0161etky potrebn\u00e9 n\u00e1le\u017eitosti. D\u00f4le\u017eit\u00e9 to je aj z d\u00f4vodu, \u017ee z\u00e1kon upravuje 30 d\u0148ov\u00fa lehotu na podanie \u017ealoby, pri\u010dom t\u00e1to lehota m\u00e1 prekluz\u00edvny charakter. Po uplynut\u00ed lehoty pr\u00e1vo zanik\u00e1. S\u00fad na zme\u0161kanie lehoty prihliada z&nbsp;\u00faradnej povinnosti aj bez n\u00e1mietky protistrany.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ako v\u00e1m m\u00f4\u017eeme pom\u00f4c\u0165?<\/h2>\n\n\n\n<p>Odpor\u00fa\u010dame V\u00e1m pri zva\u017eovan\u00ed tohto typu \u017ealoby poradi\u0165 sa so sk\u00fasen\u00fdm advok\u00e1tom.
