Na uplatnenie n\u00e1rokov z&nbsp;poru\u0161enia predkupn\u00e9ho pr\u00e1va podielov\u00e9ho spoluvlastn\u00edka sa vz\u0165ahuje <strong>v\u0161eobecn\u00e1 preml\u010dacia doba v&nbsp;trvan\u00ed troch (3) rokov<\/strong>.<\/p>\n\n\n\n<p>Po uplynut\u00ed preml\u010dacej doby sa u\u017e ob\u00edden\u00fd podielov\u00fd spoluvlastn\u00edk nedom\u00f4\u017ee n\u00e1rokov, ktor\u00e9 mu z&nbsp;poru\u0161enia predkupn\u00e9ho pr\u00e1va vypl\u00fdvaj\u00fa, pokia\u013e \u017ealovan\u00fd pod\u00e1 n\u00e1mietku preml\u010dania. V&nbsp;takomto pr\u00edpade bude s\u00edce n\u00e1rok ob\u00edden\u00e9ho spoluvlastn\u00edka existova\u0165, ale nebude mu m\u00f4c\u0165 by\u0165 s\u00fadom priznan\u00fd a&nbsp;nebude vymo\u017eite\u013en\u00fd.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Za\u010datie plynutia preml\u010dacej doby<\/strong><\/h2>\n\n\n\n<p>Okrem d\u013a\u017eky preml\u010dacej doby je d\u00f4le\u017eit\u00e9 aj to, kedy presne t\u00e1to preml\u010dacia doba za\u010d\u00edna plyn\u00fa\u0165. Pod\u013ea \u00a7 101 Ob\u010dianskeho z\u00e1konn\u00edka preml\u010dacia doba za\u010d\u00edna plyn\u00fa\u0165 <strong>odo d\u0148a, ke\u010f sa pr\u00e1vo mohlo vykona\u0165 po prv\u00fd raz<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Za\u010diatok plynutia preml\u010dacej doby pri \u017ealovan\u00ed relat\u00edvnej neplatnosti zmluvy<\/strong><\/h2>\n\n\n\n<p>Ak sa ob\u00edden\u00fd spoluvlastn\u00edk rozhodne, \u017ee sa bude dom\u00e1ha\u0165 relat\u00edvnej neplatnosti zmluvy, ktorou bol spoluvlastn\u00edcky podiel preveden\u00fd, za\u010d\u00edna preml\u010dacia doba (pod\u013ea rozsudku Najvy\u0161\u0161ieho s\u00fadu Slovenskej republiky 4Cdo\/37\/2007) plyn\u00fa\u0165 d\u0148om uzavretia k\u00fapnej zmluvy, ktorou bolo poru\u0161en\u00e9 predkupn\u00e9 pr\u00e1vo. Podielov\u00fd spoluvlastn\u00edk, ktor\u00e9ho predkupn\u00e9 pr\u00e1vo bolo poru\u0161en\u00e9 sa m\u00f4\u017ee dovol\u00e1va\u0165 relat\u00edvnej neplatnosti pr\u00e1vneho \u00fakonu pred vkladom vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed. V&nbsp;zmysle uveden\u00e9ho rozsudku z\u00e1pis vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed na plynutie preml\u010dacej doby v&nbsp;takomto pr\u00edpade vplyv nem\u00e1.<\/p>\n\n\n\n<p>Tak\u00fdto pr\u00edstup pova\u017eujeme za problematick\u00fd, ke\u010f\u017ee ob\u00edden\u00fd spoluvlastn\u00edk sa o&nbsp;uzavret\u00ed k\u00fapnej zmluvy v\u00f4bec nemus\u00ed dozvedie\u0165, pokia\u013e e\u0161te nedo\u0161lo k&nbsp;z\u00e1pisu do katastra nehnute\u013enost\u00ed. Takisto to vytv\u00e1ra priestor na to, aby zmluvn\u00e9 strany mohli zmluvu uzavrie\u0165 a n\u00e1sledne \u00fa\u010delovo po\u010dka\u0165 s&nbsp;podan\u00edm n\u00e1vrhu na vklad vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed a\u017e do uplynutia preml\u010dacej doby.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Za\u010diatok plynutia preml\u010dacej doby pri dom\u00e1han\u00ed sa pon\u00faknutia podielu ob\u00edden\u00e9mu spoluvlastn\u00edkovi<\/strong><\/h2>\n\n\n\n<p>Pokia\u013e sa ob\u00edden\u00fd spoluvlastn\u00edk rozhodne, \u017ee sa bude dom\u00e1ha\u0165 toho, aby mu spoluvlastn\u00edk, ktor\u00fd spoluvlastn\u00edcky podiel nadobudol na z\u00e1klade poru\u0161enia jeho predkupn\u00e9ho pr\u00e1va predmetn\u00fd spoluvlastn\u00edcky podiel pon\u00fakol na odk\u00fapenie za rovnak\u00fdch podmienok, za ak\u00fdch ho nadobudol, preml\u010dacia doba za\u010dne plyn\u00fa\u0165 a\u017e odo d\u0148a nasleduj\u00faceho po dni, v&nbsp;ktorom vznikol \u00fa\u010dinok z\u00e1pisu vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed na z\u00e1klade k\u00fapnej zmluvy, ktorou bolo poru\u0161en\u00e9 predkupn\u00e9 pr\u00e1vo.<\/p>\n\n\n\n<p>Ke\u010f\u017ee samotn\u00e1 k\u00fapna zmluva m\u00e1 len majetkov\u00e9 \u00fa\u010dinky (via\u017ee len jej \u00fa\u010dastn\u00edkov) a jej vecn\u00e9 \u00fa\u010dinky  (nadobudnutie vlastn\u00edctva nadob\u00fadate\u013eom) nast\u00e1vaj\u00fa a\u017e pri z\u00e1pise vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed, trojro\u010dn\u00e1 preml\u010dacia lehota na v\u00fdkon z\u00e1konn\u00e9ho predkupn\u00e9ho pr\u00e1va za\u010d\u00edna plyn\u00fa\u0165 v de\u0148 nasleduj\u00faci po dni, ke\u010f vznikli \u00fa\u010dinky z\u00e1pisu pr\u00e1va do katastra nehnute\u013enost\u00ed.<\/p>\n\n\n\n<p>Pr\u00e1vo ob\u00edden\u00e9ho spoluvlastn\u00edka bolo s\u00edce poru\u0161en\u00e9 u\u017e uzavret\u00edm k\u00fapnej (alebo inej) zmluvy, av\u0161ak opr\u00e1vnenie dom\u00e1ha\u0165 sa od nadob\u00fadate\u013ea, aby mu vec pon\u00fakol na predaj vznik\u00e1 a\u017e momentom, ke\u010f nadob\u00fadate\u013e nadobudol vlastn\u00edcke pr\u00e1vo k&nbsp;nehnute\u013enosti. V&nbsp;\u010dase, kedy nadob\u00fadate\u013e e\u0161te nie je vlastn\u00edk (nebol povolen\u00fd vklad jeho vlastn\u00edckeho pr\u00e1va), nem\u00f4\u017ee ob\u00edden\u00e9mu vlastn\u00edkovi spoluvlastn\u00edcky podiel pon\u00faknu\u0165 na predaj.
