V&nbsp;stru\u010dnom \u010dl\u00e1nku V\u00e1m predstav\u00edme z\u00e1kladn\u00e9 pr\u00e1vne aspekty podielov\u00e9ho spoluvlastn\u00edctva.<\/p>\n\n\n\n<p>Vec m\u00f4\u017ee by\u0165 v spoluvlastn\u00edctve viacer\u00fdch vlastn\u00edkov. Spoluvlastn\u00edcky podiel je ide\u00e1lny, nie re\u00e1lny. Zjednodu\u0161ene si to m\u00f4\u017eeme predstavi\u0165 tak, \u017ee podielov\u00fd spoluvlastn\u00edk vlastn\u00edk m\u00e1 svoj podiel v ka\u017edom milimetri \u0161tvorcovom pozemku a nem\u00e1 nejak\u00fa konkr\u00e9tne vymedzite\u013en\u00fa \u010das\u0165 zodpovedaj\u00facu svojmu podielu.<\/p>\n\n\n\n<p><strong>Podiel<\/strong> vyjadruje mieru, akou sa spoluvlastn\u00edci podie\u013eaj\u00fa na pr\u00e1vach a povinnostiach vypl\u00fdvaj\u00facich zo spoluvlastn\u00edctva k spolo\u010dnej veci. Ak nie je pr\u00e1vnym predpisom ustanoven\u00e9 alebo \u00fa\u010dastn\u00edkmi dohodnut\u00e9 inak, s\u00fa podiely v\u0161etk\u00fdch spoluvlastn\u00edkov rovnak\u00e9.<\/p>\n\n\n\n<p>Z pr\u00e1vnych \u00fakonov t\u00fdkaj\u00facich sa spolo\u010dnej veci s\u00fa opr\u00e1vnen\u00ed a povinn\u00ed v\u0161etci spoluvlastn\u00edci spolo\u010dne a nerozdielne.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Hospod\u00e1renie so spolo\u010dnou vecou<\/strong><\/h2>\n\n\n\n<p>O hospod\u00e1ren\u00ed so spolo\u010dnou vecou rozhoduj\u00fa spoluvlastn\u00edci v\u00e4\u010d\u0161inou po\u010d\u00edtanou pod\u013ea ve\u013ekosti podielov. Pri rovnosti hlasov, alebo ak sa v\u00e4\u010d\u0161ina alebo dohoda nedosiahne, rozhodne na n\u00e1vrh ktor\u00e9hoko\u013evek spoluvlastn\u00edka <strong>s\u00fad<\/strong>. Ak ide o d\u00f4le\u017eit\u00fa zmenu spolo\u010dnej veci, m\u00f4\u017eu prehlasovan\u00ed spoluvlastn\u00edci \u017eiada\u0165, aby o zmene rozhodol s\u00fad.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Z\u00e1konn\u00e9 predkupn\u00e9 pr\u00e1vo (podielov\u00e9ho spoluvlastn\u00edka)<\/strong><\/h2>\n\n\n\n<p>Ak sa spoluvlastn\u00edcky podiel prev\u00e1dza, maj\u00fa spoluvlastn\u00edci <strong>predkupn\u00e9 pr\u00e1vo<\/strong>, iba\u017ee ide o prevod bl\u00edzkej osobe. Bl\u00edzkou osobou je v zmysle Ob\u010dianskeho z\u00e1konn\u00edka pr\u00edbuzn\u00fd v priamom rade, s\u00farodenec a man\u017eel; in\u00e9 osoby v pomere rodinnom alebo obdobnom sa pokladaj\u00fa za osoby sebe navz\u00e1jom bl\u00edzke, ak by ujmu, ktor\u00fa utrpela jedna z nich, druh\u00e1 d\u00f4vodne poci\u0165ovala ako vlastn\u00fa ujmu. Ak sa spoluvlastn\u00edci nedohodn\u00fa o v\u00fdkone predkupn\u00e9ho pr\u00e1va, maj\u00fa pr\u00e1vo vyk\u00fapi\u0165 podiel pomerne pod\u013ea ve\u013ekosti podielov.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/uplatnenie-narokov-z-porusenia-predkupneho-prava-a-pozemkove-upravy\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/uplatnenie-narokov-z-porusenia-predkupneho-prava-a-pozemkove-upravy\/\">Uplatnenie n\u00e1rokov z poru\u0161enia predkupn\u00e9ho pr\u00e1va a pozemkov\u00e9 \u00fapravy<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Zru\u0161enie a&nbsp;vyporiadanie podielov\u00e9ho spoluvlastn\u00edctva<\/strong><\/h2>\n\n\n\n<p><strong>Spoluvlastn\u00edci sa m\u00f4\u017eu dohodn\u00fa\u0165 o zru\u0161en\u00ed spoluvlastn\u00edctva a o vz\u00e1jomnom vyporiadan\u00ed<\/strong>; ak je predmetom spoluvlastn\u00edctva nehnute\u013enos\u0165, dohoda mus\u00ed by\u0165 p\u00edsomn\u00e1. Ka\u017ed\u00fd zo spoluvlastn\u00edkov je povinn\u00fd vyda\u0165 ostatn\u00fdm na po\u017eiadanie p\u00edsomn\u00e9 potvrdenie o tom, ako sa vyporiadali, ak nemala u\u017e dohoda o zru\u0161en\u00ed spoluvlastn\u00edctva a o vz\u00e1jomnom vyporiadan\u00ed p\u00edsomn\u00fa formu. <strong>Ak ned\u00f4jde k dohode, zru\u0161\u00ed spoluvlastn\u00edctvo a vykon\u00e1 vyporiadanie na n\u00e1vrh niektor\u00e9ho spoluvlastn\u00edka s\u00fad.<\/strong> Prihliadne pritom na ve\u013ekos\u0165 podielov a na \u00fa\u010deln\u00e9 vyu\u017eitie veci.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Sp\u00f4soby vyporiadania<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>re\u00e1lne rozdelenie veci;<\/li>\n\n\n\n<li>prik\u00e1zanie veci jedn\u00e9mu alebo viacer\u00fdm spoluvlastn\u00edkom za n\u00e1hradu;<\/li>\n\n\n\n<li>predaj veci a&nbsp;rozdelenie v\u00fd\u0165a\u017eku medzi spoluvlastn\u00edkov pod\u013ea ich podielov.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Rozdelenie veci<\/strong><\/h3>\n\n\n\n<p>Je mo\u017en\u00e9 len za splnenia podmienky, \u017ee re\u00e1lne rozdelenie je <strong>dobre mo\u017en\u00e9<\/strong>. To znamen\u00e1, \u017ee mus\u00ed \u00eds\u0165 nie len o&nbsp;faktick\u00fa mo\u017enos\u0165 a&nbsp;technick\u00fa vykonate\u013enos\u0165 rozdelenia, ale aj o&nbsp;funk\u010dn\u00fa opodstatnenos\u0165 rozdelenia. D\u00f4le\u017eit\u00fd je aj aspekt finan\u010dnej n\u00e1kladnosti rozdelenia.<\/p>\n\n\n\n<p>Pri zru\u0161en\u00ed a vyporiadan\u00ed spoluvlastn\u00edctva rozdelen\u00edm veci m\u00f4\u017ee s\u00fad zriadi\u0165 vecn\u00e9 bremeno k novovzniknutej nehnute\u013enosti v prospech vlastn\u00edka inej novovzniknutej nehnute\u013enosti. Zru\u0161enie a vyporiadanie spoluvlastn\u00edctva nem\u00f4\u017ee by\u0165 na ujmu osob\u00e1m, ktor\u00fdm patria pr\u00e1va viazn\u00face na nehnute\u013enosti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Prik\u00e1zanie veci<\/strong><\/h3>\n\n\n\n<p>Ak nie je rozdelenie veci dobre mo\u017en\u00e9, prik\u00e1\u017ee s\u00fad vec za primeran\u00fa n\u00e1hradu jedn\u00e9mu alebo viacer\u00fdm spoluvlastn\u00edkom; prihliadne pritom na to, aby sa vec mohla \u00fa\u010delne vyu\u017ei\u0165 a na n\u00e1siln\u00e9 spr\u00e1vanie podielov\u00e9ho spoluvlastn\u00edka vo\u010di ostatn\u00fdm spoluvlastn\u00edkom.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Predaj veci<\/strong><\/h3>\n\n\n\n<p>Ak vec \u017eiadny zo spoluvlastn\u00edkov nechce, s\u00fad nariadi jej predaj a v\u00fd\u0165a\u017eok rozdel\u00ed pod\u013ea podielov.
