Ide o Rozsudok <a href=\"https:\/\/www.nsud.sk\/\">Najvy\u0161\u0161ieho s\u00fadu Slovenskej republiky<\/a> z 30. novembra 2021, sp. zn. <strong>3Cdo\/219\/2019<\/strong>. V&nbsp;predmetnom konan\u00ed s\u00fad posudzoval vplyv uskuto\u010dnenia pozemkov\u00fdch \u00faprav na mo\u017enos\u0165 uplat\u0148ovania n\u00e1rokov z&nbsp;poru\u0161enia predkupn\u00e9ho pr\u00e1va podielov\u00e9ho spoluvlastn\u00edka na pozemky dotknut\u00e9 pozemkov\u00fdmi \u00fapravami.<\/p>\n\n\n\n<p>S\u00fad rozhodol, \u017ee ak do\u0161lo k\u00a0poru\u0161eniu z\u00e1konn\u00e9ho predkupn\u00e9ho pr\u00e1va <a href=\"https:\/\/www.lidaybasaryova.sk\/en\/podielove-spoluvlastnictvo\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/podielove-spoluvlastnictvo\/\">podielov\u00e9ho spoluvlastn\u00edka<\/a> a\u00a0podielov\u00fd spoluvlastn\u00edk sa dom\u00e1ha toho, aby nadob\u00fadate\u013e podielu nadobudnut\u00fd podiel na neho previedol, ale pred uspokojen\u00edm pr\u00e1va ob\u00edden\u00e9ho spoluvlastn\u00edka d\u00f4jde vo vz\u0165ahu k\u00a0predmetn\u00fdm pozemkom k\u00a0pr\u00e1voplatn\u00e9mu vykonaniu pozemkov\u00fdch \u00faprav, <strong>n\u00e1rok ob\u00edden\u00e9ho podielov\u00e9ho spoluvlastn\u00edka z\u00a0poru\u0161enia predkupn\u00e9ho pr\u00e1va zanikne<\/strong>, ke\u010f\u017ee zanikne aj pozemok v\u00a0podielovom spoluvlastn\u00edctve. <strong>K\u00a0<\/strong>v\u00a0r\u00e1mci pozemkov\u00fdch \u00faprav <strong>novovzniknut\u00fdm pozemkom u\u017e<\/strong> ob\u00edden\u00fd podielov\u00fd spoluvlastn\u00edk <strong>n\u00e1rok na prevod pozemku alebo spoluvlastn\u00edckeho podielu nem\u00e1<\/strong>, a\u00a0to ani napriek tomu, \u017ee novovzniknut\u00fd pozemok bol p\u00f4vodne tvoren\u00fd pozemkom, vo vz\u0165ahu ku ktor\u00e9mu bolo poru\u0161en\u00e9 jeho predkupn\u00e9 pr\u00e1vo.<\/p>\n\n\n\n<p><strong><em>Pokia\u013e m\u00e1te \u0165a\u017ekosti s uplat\u0148ovan\u00edm svojich pr\u00e1v s\u00favisiacich s podielov\u00fdm spoluvlastn\u00edctvom, radi V\u00e1m pom\u00f4\u017eeme.<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/spoluvlastnik-nesuhlasi-s-predajom-pozemku-ake-mam-moznosti\/\">Spoluvlastn\u00edk nes\u00fahlas\u00ed s predajom pozemku, ak\u00e9 m\u00e1m mo\u017enosti?<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/zmena-v-prenajimani-pody-slovenskym-pozemkovym-fondom\/\">Zmeny v prenaj\u00edman\u00ed p\u00f4dy Slovensk\u00fdm pozemkov\u00fdm fondom<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.lidaybasaryova.sk\/en\/premlcanie-narokov-z-porusenia-predkupneho-prava\/\" data-type=\"link\" data-id=\"https:\/\/www.lidaybasaryova.sk\/premlcanie-narokov-z-porusenia-predkupneho-prava\/\">Preml\u010danie n\u00e1rokov z poru\u0161enia predkupn\u00e9ho pr\u00e1va<\/a><\/li>\n<\/ul>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-373c8d15\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-373c8d15\"><strong>Prvostup\u0148ov\u00e9 a&nbsp;odvolacie konanie<\/strong><\/h2>\n\n\n\n<p>Podielov\u00ed spoluvlastn\u00edci, ktor\u00fdch z\u00e1konn\u00e9 predkupn\u00e9 pr\u00e1vo bolo poru\u0161en\u00e9 sa obr\u00e1tili na s\u00fad, pri\u010dom \u017eiadali, aby s\u00fad nahradil prejav v\u00f4le \u017ealovan\u00e9ho uzavrie\u0165 k\u00fapnu zmluvu, ktorou by na \u017ealobcov previedol spoluvlastn\u00edcke podiely na pozemkoch. S\u00fad \u017ealobe vo vz\u0165ahu k&nbsp;\u010dasti pozemkov v&nbsp;podielovom spoluvlastn\u00edctve vyhovel, av\u0161ak vo vz\u0165ahu k&nbsp;\u010dasti pozemkom \u017ealobu zamietol.<\/p>\n\n\n\n<p>D\u00f4vodom zamietnutia \u017ealoby vo vz\u0165ahu k&nbsp;t\u00fdmto pozemkom bola skuto\u010dnos\u0165, \u017ee i\u0161lo o&nbsp;pozemky, vo vz\u0165ahu ku ktor\u00fdm sa uskuto\u010dnili pozemkov\u00e9 \u00fapravy v&nbsp;zmysle <a href=\"https:\/\/www.slov-lex.sk\/pravne-predpisy\/SK\/ZZ\/1991\/330\/\">z\u00e1kona \u010d. 330\/1991 Zb.<\/a> o pozemkov\u00fdch \u00faprav\u00e1ch, usporiadan\u00ed pozemkov\u00e9ho vlastn\u00edctva, pozemkov\u00fdch \u00faradoch, pozemkovom fonde a o pozemkov\u00fdch spolo\u010denstv\u00e1ch (\u010falej ako \u201ez\u00e1kon o&nbsp;pozemkov\u00fdch \u00faprav\u00e1ch\u201c).<\/p>\n\n\n\n<p>S\u00fad pritom vych\u00e1dza z&nbsp;toho, \u017ee na z\u00e1klade pozemkov\u00fdch \u00faprav vznikli v&nbsp;danom katastr\u00e1lnom \u00fazem\u00ed nov\u00e9 parcely a&nbsp;vo vz\u0165ahu k&nbsp;t\u00fdmto novovzniknut\u00fdm parcel\u00e1m \u017ealobcom spoluvlastn\u00edcke pr\u00e1vo, ani predkupn\u00e9 pr\u00e1vo nikdy nesved\u010dalo. Rozsudok bol n\u00e1sledne potvrden\u00fd aj odvolac\u00edm s\u00fadom.<\/p>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-160d89ad\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-160d89ad\"><strong>Dovolacie konanie<\/strong><\/h2>\n\n\n\n<p>Ke\u010f\u017ee rozhodnutie odvolacieho s\u00fadu z\u00e1viselo od vyrie\u0161enia pr\u00e1vnej ot\u00e1zky, doposia\u013e nerie\u0161enej dovolac\u00edm s\u00fadom, <strong>\u010di za situ\u00e1cie, ke\u010f si \u017ealobcovia ako spoluvlastn\u00edci nehnute\u013enost\u00ed uplatnili vo\u010di \u017ealovan\u00e9mu, ktor\u00fd nadobudol na t\u00fdchto nehnute\u013enostiach spoluvlastn\u00edcky podiel bez re\u0161pektovania predkupn\u00e9ho pr\u00e1va \u017ealobcov, svoje pr\u00e1va, ktor\u00e9 im vyplynuli z tohto poru\u0161enia ich predkupn\u00e9ho pr\u00e1va a pred uspokojen\u00edm t\u00fdchto pr\u00e1v d\u00f4jde k pr\u00e1voplatn\u00e9mu vykonaniu pozemkov\u00fdch \u00faprav v katastri, v ktorom sa tieto nehnute\u013enosti nach\u00e1dzaj\u00fa a pozemkov\u00e9 \u00fapravy sa t\u00fdchto nehnute\u013enost\u00ed t\u00fdkaj\u00fa, tieto pr\u00e1va \u017ealobcov ako spoluvlastn\u00edkov zanikaj\u00fa alebo nezanikaj\u00fa a vz\u0165ahuj\u00fa sa na nov\u00e9 nehnute\u013enosti \u017ealovan\u00e9ho, ktor\u00e9 vznikli pri t\u00fdchto pozemkov\u00fdch \u00faprav\u00e1ch a s\u00fa odvoden\u00e9 z jeho spoluvlastn\u00edckych podielov na p\u00f4vodn\u00fdch nehnute\u013enostiach<\/strong>, rozhodli sa \u017ealobcovia pre podanie dovolania na Najvy\u0161\u0161\u00ed s\u00fad.<\/p>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-8c6bc019\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-8c6bc019\"><strong>Argument\u00e1cia \u017ealobcov<\/strong><\/h2>\n\n\n\n<p>\u017dalobcovia v&nbsp;konan\u00ed argumentovali predov\u0161etk\u00fdm t\u00fdm, \u017ee z\u00e1kon o&nbsp;pozemkov\u00fdch \u00faprav\u00e1ch nezakotvuje ustanovenie o&nbsp;z\u00e1niku pr\u00e1v vypl\u00fdvaj\u00facich z&nbsp;poru\u0161enia z\u00e1konn\u00e9ho predkupn\u00e9ho pr\u00e1va podielov\u00e9ho spoluvlastn\u00edka, hoci upravuje z\u00e1nik in\u00fdch pr\u00e1v, ako napr. pr\u00e1v vypl\u00fdvaj\u00facich z&nbsp;n\u00e1jomn\u00fdch vz\u0165ahov. Pod\u013ea \u017ealobcov preto niet \u017eiadneho z\u00e1konn\u00e9ho podkladu pre \u00favahu, \u017ee schv\u00e1len\u00edm projektu pozemkov\u00fdch \u00faprav zanik\u00e1 aj u\u017e uplatnen\u00e9 pr\u00e1vo v d\u00f4sledku poru\u0161enia predkupn\u00e9ho pr\u00e1va, ak by tomu tak malo by\u0165, tak by pod\u013ea nich by z\u00e1kon s tak\u00fdmto n\u00e1sledkom musel po\u010d\u00edta\u0165, o to viac, \u017ee v in\u00fdch pr\u00edpadoch s t\u00fdm po\u010d\u00edta.<\/p>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-56ce48fe\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-56ce48fe\"><strong>Argument\u00e1cia \u017ealovan\u00e9ho<\/strong><\/h2>\n\n\n\n<p>\u017dalovan\u00fd argumentoval aj t\u00fdm, \u017ee pod\u013ea \u00a7 603 ods. 3 Ob\u010dianskeho z\u00e1konn\u00edka: \u201eak sa predkupn\u00e9 pr\u00e1vo poru\u0161ilo, m\u00f4\u017ee sa opr\u00e1vnen\u00fd bu\u010f od nadob\u00fadate\u013ea dom\u00e1ha\u0165, <strong>aby mu vec pon\u00fakol na predaj<\/strong>, alebo mu zostane predkupn\u00e9 pr\u00e1vo zachovan\u00e9.\u201c Av\u0161ak v&nbsp;danom pr\u00edpade \u017ealovan\u00fd u\u017e nem\u00f4\u017ee pon\u00faknu\u0165 \u017ealobcom vec na predaj, nako\u013eko t\u00fato vec nem\u00e1, ale m\u00e1 in\u00fa vec.<\/p>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-59418ac5\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-59418ac5\"><strong>Od\u00f4vodnenie Najvy\u0161\u0161ieho s\u00fadu<\/strong><\/h2>\n\n\n\n<p>Najvy\u0161\u0161\u00ed s\u00fad v&nbsp;od\u00f4vodnen\u00ed pouk\u00e1zal na to, \u017ee nadobudnutie pozemku v d\u00f4sledku pozemkov\u00fdch \u00faprav patr\u00ed medzi <strong>origin\u00e1rne sp\u00f4soby nadobudnutia vlastn\u00edckeho pr\u00e1va<\/strong>. V d\u00f4sledku pozemkov\u00fdch \u00faprav pod\u013ea z\u00e1kona o pozemkov\u00fdch \u00faprav\u00e1ch, doch\u00e1dza k z\u00e1niku p\u00f4vodn\u00fdch pozemkov (p\u00f4vodn\u00e9ho predmetu vlastn\u00edctva), ktor\u00fdch vlastn\u00edci z\u00edskavaj\u00fa do vlastn\u00edctva nov\u00e9 pozemky. K vytvoreniu nov\u00fdch pozemkov pritom doch\u00e1dza bez oh\u013eadu na to, z ko\u013ek\u00fdch pozemkov a s ak\u00fdm (spolu) vlastn\u00edckym re\u017eimom boli vytvoren\u00e9 a vlastn\u00edctvo k&nbsp;nim sa nadob\u00fada <strong>d\u0148om pr\u00e1voplatnosti rozhodnutia o schv\u00e1len\u00ed vykonania projektu pozemkov\u00fdch \u00faprav<\/strong> alebo neskor\u0161\u00edm d\u0148om ur\u010den\u00fdm v&nbsp;rozhodnut\u00ed.<\/p>\n\n\n\n<p>Vytvoren\u00edm nov\u00fdch pozemkov nedo\u0161lo k vzniku spoluvlastn\u00edckeho pr\u00e1va spoluvlastn\u00edkov p\u00f4vodn\u00fdch pozemkov, a preto nevzniklo ani predkupn\u00e9 pr\u00e1vo k pozemku, z uveden\u00e9ho titulu. Pozemok, ktor\u00fd mali pred pozemkovou \u00fapravou v spoluvlastn\u00edctve \u017ealobcovia a \u017ealovan\u00fd, prestal existova\u0165. \u017dalovan\u00fd na z\u00e1klade z\u00e1kona, ako je uveden\u00e9 vy\u0161\u0161ie, origin\u00e1rnym sp\u00f4sobom nadobudol individu\u00e1lne vlastn\u00edctvo k nov\u00e9mu pozemku, ur\u010den\u00e9mu pri pozemkov\u00fdch \u00faprav\u00e1ch.<\/p>\n\n\n\n<p>Najvy\u0161\u0161\u00ed s\u00fad taktie\u017e pouk\u00e1zal na to, \u017ee z\u00e1kon umo\u017enil \u00fa\u010dastn\u00edkom konania o pozemkov\u00fdch \u00faprav\u00e1ch sa riadne obozn\u00e1mi\u0165 s n\u00e1vrhom projektu a&nbsp;mali mo\u017enos\u0165 sa vyjadrova\u0165 a pod\u00e1va\u0165 n\u00e1mietky v spr\u00e1vnom konan\u00ed. V pr\u00edpade, \u017ee by sa \u017ealobcovia dom\u00e1hali prechodu vlastn\u00edctva vo svoj prospech z&nbsp;titulu neuplatnenia predkupn\u00e9ho pr\u00e1va a uplatnili si t\u00fato po\u017eiadavku ako \u00fa\u010dastn\u00edci pozemkov\u00fdch \u00faprav, vzh\u013eadom na term\u00edn, kedy podali \u017ealobu po vytvoren\u00ed umiest\u0148ovacieho pl\u00e1nu, by kupuj\u00faci mohol zru\u0161i\u0165 k\u00fapnopredajn\u00e9 zmluvy s pred\u00e1vaj\u00facim dohodou, a&nbsp;tak by sa mohlo zachova\u0165 umiestnenie pod\u013ea nov\u00e9ho stavu, kde na nov\u00fdch parcel\u00e1ch by sa viedli p\u00f4vodn\u00ed vlastn\u00edci, ktor\u00ed by potvrdili navrhnut\u00e9 umiestnenie.<\/p>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-83df95c7\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-83df95c7\"><strong>Pr\u00e1vna veta<\/strong><\/h2>\n\n\n\n<p><strong>\u201e\u00da\u010delom z\u00e1kona SNR \u010d. 330\/1991 Zb. o pozemkov\u00fdch \u00faprav\u00e1ch, usporiadan\u00ed pozemkov\u00e9ho vlastn\u00edctva, pozemkov\u00fdch \u00faradoch, pozemkovom fonde a&nbsp;pozemkov\u00fdch spolo\u010denstv\u00e1ch bola \u00faprava vlastn\u00edckych vz\u0165ahov k pozemkom, nie vytv\u00e1ranie \u010fal\u0161\u00edch odvoden\u00fdch pr\u00e1vnych vz\u0165ahov z h\u013eadiska vzniku vlastn\u00edctva.
