In the past, land properties, in particular, were often left undistributed.<a href=\"https:\/\/www.lidaybasaryova.sk\/en\/2021-ako-prist-k-dedicstvu-o-ktorom-ste-ani-nevedeli\/\">We address the reasons in more detail in a previous article.<\/a>What steps should be taken when such a situation arises? According to Article no. 159 of the Civil Non-Contentious Procedure Code: \"The court that concluded the inheritance proceedings has local jurisdiction for additional inheritance proceedings.\" It is, therefore, necessary to submit a proposal to the court.<\/p>\n\n\n\n<h3 id=\"ak\u00e9\" class=\"wp-block-themeisle-blocks-advanced-heading ak\u00e9\">Requirements for filing a request for additional inheritance proceedings<\/h3>\n\n\n\n<p>The request for additional inheritance proceedings should mainly include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>identification of the court to which the proposal is addressed<\/li>\n\n\n\n<li>the person submitting the proposal<\/li>\n\n\n\n<li>definition of the legator after whom the inheritance is to be distributed<\/li>\n\n\n\n<li>the purpose of the request \u2013 conducting additional inheritance proceedings<\/li>\n\n\n\n<li>definition of the legator's heirs according to the inheritance order<\/li>\n\n\n\n<li>definition of the legator's property that you want to inherit (so-called newly discovered property)<\/li>\n\n\n\n<li>signature of the applicant<\/li>\n\n\n\n<li>attachments<\/li>\n<\/ul>\n\n\n\n<p>While it is not essential for the definition of the legator's property and the scope of his heirs to be complete in the proposal, providing precise and detailed information to the court may affect the duration of the proceedings. Pokia\u013e teda prede\u010fujete pozemky napr. po prastarom otcovi, v&nbsp;ide\u00e1lnom pr\u00edpade je potrebn\u00e9 dolo\u017ei\u0165 dokument, ktor\u00fdm sa ukon\u010dilo dedi\u010dsk\u00e9 konanie, ktor\u00e9 prebehlo (ak prebehlo) po jeho smrti, rozhodnutia, ktor\u00fdmi sa ukon\u010dilo dedi\u010dsk\u00e9 konanie po v\u0161etk\u00fdch jeho dedi\u010doch, ktor\u00ed s\u00fa u\u017e zosnul\u00ed a\u017e po \u017eij\u00facich dedi\u010dov.<\/p>\n\n\n\n<h3 id=\"ako\" class=\"wp-block-themeisle-blocks-advanced-heading ako\">How Additional Inheritance Proceedings Take Place<\/h3>\n\n\n\n<p>After the initial steps, the court will assign a notary to go into the matter. Notary will act as a judicial commissioner in the proceedings. After verifying the extent of the property, its estimated value, and the circle of heirs, the notary will ideally reach an agreement with the heirs on the distribution of the inheritance, any payments, and the like.<\/p>\n\n\n\n<p>The notary will summon the heirs for a hearing. Especially in cases where inheritance is after a predecessor from several generations ago, the circle of heirs can be quite extensive. In our practice, we have attended discussions where 45 heirs were summoned, so we recommend considering the possibility of appointing a representative for the heirs. The hearing is completed by the legal force of the resolution on the inheritance.<\/p>\n\n\n\n<h3 id=\"s\" class=\"wp-block-themeisle-blocks-advanced-heading s\">Fees<\/h3>\n\n\n\n<p>If you decide to embark on this process, you need to consider the following costs:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Court fees<\/strong> \u2013 v\u00fd\u0161ku s\u00fadnych poplatkov upravuje z\u00e1kon o\u00a0s\u00fadnych poplatkoch, pod\u013ea ktor\u00e9ho je v\u00fd\u0161ka poplatku za podanie n\u00e1vrhu na prejednanie dedi\u010dstva k\u00a0novoobjaven\u00e9mu majetku 1 % z \u010distej hodnoty dedi\u010dstva, ktor\u00e9 sa m\u00e1 prejedna\u0165, najmenej 6,50 eura, najviac 165,50 eura.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Notary fees<\/strong> &#8211; v\u00fd\u0161ku not\u00e1rskych poplatkov upravuje vyhl\u00e1\u0161ka Ministerstva spravodlivosti Slovenskej republiky o odmen\u00e1ch a n\u00e1hrad\u00e1ch not\u00e1rov. V\u00a0tomto pr\u00edpade je z\u00e1kladom odmeny s\u00fadneho komis\u00e1ra za \u00fakony vykonan\u00e9 v konan\u00ed je v\u0161eobecn\u00e1 hodnota prejedn\u00e1van\u00e9ho majetku. V\u00fd\u0161ka poplatku v\u00a0zmysle \u00a7 13 vyhl\u00e1\u0161ky sa vypo\u010d\u00edta nasledovne:<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>2 % of the first \u20ac 3,300 of the base,<\/li>\n\n\n\n<li>z presahuj\u00facej sumy a\u017e do 16 500 eur z\u00e1kladu\u00a0\u00a0\u00a0\u00a0 1 %,<\/li>\n\n\n\n<li>0.7% of the amount exceeding up to \u20ac 33,100 of the base, <\/li>\n\n\n\n<li>0.4% of the amount exceeding up to \u20ac 99,500 of the base<\/li>\n\n\n\n<li>0.2% of the amount exceeding up to \u20ac 663,800 of the base<\/li>\n\n\n\n<li>The amount above \u20ac 663,800 is not included in the base.<\/li>\n<\/ul>\n\n\n\n<p>In addition, the notary is entitled to reimbursement of actual expenses, such as postage and the like.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Other fees<\/strong> \u2013 e.g., fee for making photocopies of archival documents, postage for individual submissions, certification of a signature on a power of attorney for the discussion of inheritance, and the like.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"na\u0161e\" class=\"wp-block-themeisle-blocks-advanced-heading na\u0161e\">Our recommendation<\/h3>\n\n\n\n<p>Vzh\u013eadom na to, \u017ee cel\u00fd proces je \u010dasto zd\u013ahav\u00fd a&nbsp;je spojen\u00fd aj s&nbsp;n\u00e1kladmi, odpor\u00fa\u010dame vopred zhodnoti\u0165, ak\u00e9 pozemky by boli predmetom dedenia.
